Because if the rules simply stated that you had to have a cat, somebody would fab up something that technically qualified as a "catalytic convertor", but didn't do much to reduce emissions.
I've actually been wondering what would happen if I showed up with my completely empty stock cat. It's original equipment on the vehicle, unmodified, but completely useless as a cat. If I'd never had it off the vehicle, I may have never known there was nothing in it, and if there were no emissions testing here, I'd never have any reason to find out. Ruling?
Ruling = no. Faulty OE equipment is just as illegal as aftermarket stuff. Been through this argument before. While we're on the topic, check out the latest issue of GRM. Andy hollis did a good bit of testing on various aftermarket cats for the miata. Also, the ST rules state that you need to be able to pass a sniffer test should someone protest you.

I honestly don't remember. Off the top of my head, I remember a magnaflow direct replacement doing very well on the sniffer test, while still making about 2 lb/ft & hp over stock.
I figured as much, but I guess you'd just be the only one "surprised" when you lost the protest.
Yeah, saw that article. IIRC, the little Magnaflow made the most power and was the lightest by quite a bit, so I'm sure that's what Andy went with, though I don't think he said which was staying on the car.
I think you're right. You're thinking of the Magnaflow Spun cat, not the direct fit one.
That's the one. I couldn't remember the name, but I knew you'd know which one I meant by the "little" one.
Which is total bulls*** since emission standards vary widely from not only State to State but County to County as well.
