Unless it is done at the scene of a crime, this type of evidence woun't be admittable in court, you would have to hire someone to inspect the tire marks and prove they came from the motor cycle and there would have to be photographs of the scene to show where the bike slid.

The only time the police go to this trouble is when there is a fatality...trust me it happens on a regular basis on highways in MA and the only time they block the road and take measurements and evidence is when someone is going home in the meat wagon.

Be thankfull that you are alive and maybe the next time someone pulls out in front of you, you will use the time wisely and slam on your brakes instead of attempting to maneuver around them. I know you probably tried both but you must have seen this truck inching for the curb...if you didn't think she saw you, you should have been on the brakes immediately. Motorcycles are dangerous and they turn even the simplest fender-benders into horrific accidents. Motorcylcists cannot be aggressive drivers...they must always be on the defensive becuase we all know that there are more bad drivers on the road than good.

Regardless of whether it was your fault, that Mercedes driver is going to hell. Imagine how he would have felt if he turned on the news when he got home and saw that you died on the pavement. What he said is one of the rudest things I've ever heard.

I just got out of the emergency room at the VA hospital. Was on my motorcycle riding in the right hand lane, when some 16 yr old girl in a white toyota tacoma stick shift, didn't look when leaving a parking lot, pulled right out in front of me, and bogged her car. I tried to swerve into the shoulder, but ended up skidding into her truck. I was doing about 45, the speed limit, and couldn't have been going more since I just came from a red about 1 block before. I smacked the back of her truck so hard, that I went over my handlebars, head first into her tailgate, slammed both my legs and knees into her bumper, and fell underneath the car. My bike slid under her car, and slid for a good 50 feet until it hit a curb. It's totally f_cked up. I have some pretty bad bruises and a fracture in my femur. Her tail gate is all dented up from my head.

Oh it gets better....a guy in a Mercedes came up to me and said, "I hate motorcyclists, you deserve to be roadkill." Feels great knowing that I defended this guys' freedom in Iraq. To top it all off, the cops came and cited me. Said I "failed to use due care." What BS, the girl got out of her truck knowing she was wrong. She was crying and it was written all over her face. Apparently, if you hit someone from behind, regardless of circumstances, you're at fault. I might as well take my civic out, and reverse into someone's car, and sue them for a settlement. Vegas traffic laws are full of s***. So now I have a feeling her Daddy is gonna sue me. Great...I have just been robbed of my bike, my health, and soon to be .... even more money when her daddy takes me to court...hope not though...

I hope I have a case, I'm going to see the attorney tomorrow. Keep my fingers crossed...

Exact same thing happened to me 4 years ago except it was a ragtop Mustang, and I won my case. The dude in the stang had to swerve and slam the brakes to avoid hitting a girl crossing the street with her bicycle. I tried to do the same but we ended up both going in the same direction. Bike was a write-off. I nearly was too. Cops came to the hospital to ask questions. I told my story. Turns out a lot of witnesses helped me on this one. They told the sory exactly as it unfolded and I never got charged. The girl got charged for jaywalking. It was our right-of-way.

Sorry to hear about your incident. You have to be so careful, people just don't realize! And; on a bike, especially. I hope your back to 100% real soon.
 
Sorry to hear about you accident. A friend of mine got cut off by a suv. Totaled his bike. He got lucky and only broke both of his arms and the girl on his bike cracked her pelvis in 3 places. If you would have seen the accident you'd understand why I said lucky. Traffic laws concerning motorcycles need to be revised. I used to ride so I understand the dangers there are on a motorcycle.
 
Oh yeah Most mercedes drivers are pricks anyways. I does make me feel better to know that when they by there cars they lose an average of 20k.....
 
pretty much if this happened to me and i KNEW for a fact that it was not my fault and then this girl's dad tried to sue me? Im sorry but when the law is wrong and is ******* you over what the **** options do you have to turn to? This is why people go Postal...
 
There is no substitute for a GOOD attorney. Ask around in your area and find one. If it happened as you say it happened, your attorney should be able to put up a solid defense and possibly countersue. No attorney or a crappy one and you have plenty to worry about. Nobody likes a lawyer until they need one. Mine just saved my ass recently when I split with my ex, and it was worth every penny.

I hope you recover quickly and I'll say a prayer for you too. Keep us updated on how it unfolds.
 
Problem is, the law on bikes makes sense..most bike accidents are entirely the drivers fault..its just a proven statistic..unfortunate as it is..
 
Damn, Shaolin, I'm really sorry to hear what happened to you. That is pure bulls*** about it being your fault. And what the Mercedes guy said to you? HE should be roadkill, the dumbass. I hope you heal up soon and that this works out for the best for you. :(
 
Basically, the truck had a stop sign at her exit before getting out onto the main road. She disregarded it, kinda like she already had momentum coming out of that lot. I began to brake immediately and tried to swerve around her. Basically if I hadn't hit the brakes I would have t-boned her at an angle, and probably went under her wheels.
 
Thanks for all the support guys...I have a good lawyer in mind, who helped my girlfriend with her accident. As for the guy in the Benz, I couldn't get his info...cops kept me clear of him. Funny thing is that there was a guy who got off the CAT bus, and saw the whole thing, and was willing to testify on my behalf. However, the cops said he was "a vagrant type" and didn't trust him. So a Mercedes makes you more honest than a CAT bus apparently.

I can honestly say that my gear saved my life. I saw the back of the truck in my face and heard a loud crash, but after x-rays and everything, I can say that my neck is a little stiff, but other then that, my head and neck are ok...

Always wear your gear guys, and I'll keep fighting this to the end. I'll keep everyone posted.
 
good luck bud.... we're all behind you. I can't believe the stupidity of some poeple, automatically thinking it was your fault, or saying that all motorcyclists should be roadkill... just wrong....

On a side note, a woman was shot in the head by a passenger in a passing car while she was on 93S in Massachusetts. Apparently she was speeding in the passing lane and pulled over because the other car was tail-gating her. Some witnesses said the two cars were racing.

Anyway, they caught the guy and he claims he was "loading his gun before going to the city and it accidently went off". That might be a respectable claim except he happened to hit the woman square on the chin and the bullet bounce off her jaw and came out the back of her head. That means she was looking right at him when he shot her.

I hope everything is ok bro! Yeah unfortunately Nevada has this bs law if you rear end somebody your at fault. But since this is a case of a motorcycle you should be able to challenge it in court. Which attourney did you have in mind? Hmm too bad you didn't see the Mercedes Benz license plate, because I would be on a look out for that piece of sh*t. Well I hope everything goes well. If you need anything, just pm me. I've been to the courts many of times for traffic violations.:rolleyes:
