I'll leave when some company is willing to pay relo and a better salary (adjusting for changes in cost of living, of course!) Until then, I'll stay put and continue with the slow process of (finally) getting my degree and paying down debt...
 
*Update*

I had a chance to speak to my insurance agent this morning,
and she helped lay out some options for me.

1. File a claim through his insurance - the safest way.

2. Get the money from him directly -> helps him out, but it could lead to headaches if the repair ends up costing more than the amount he gives initially, or if the car has other unseen problems in the future.

3. Go through my insurance (pay the deductible), and let them work on getting the money from the guy's insurance (will refund the deductible to me afterwards).

She said that if I choose to go with his insurance, I should call them without contacting D. Donahue first because if he lies to them (just like his complete denial at the accident scene before fleeing and how he acted like he had no recollection of ramming my car when he contacted me last night).

I weighed the options carefully and finally decided to use his insurance, not because I was trying to punish him, but because I desired no more complications. Okay... maybe I do want a *tiny bit* of punishment since 1. he tried numerous times to get my car to crash while I was chasing him 2. he acted like he had absolutely no idea about the accident. I know some of the members here have mentioned the possibility of mental conditions, but I don't buy that. I mean if he really thought he was innocent, why would the family take the words of some stranger in VA about some random accident asking for compensation? The fact that he actually called me tells me that he realizes the grim remifications if he doesn't fix the situation right away because him running away from the accident didn't serve him any good (since he was tracked down).

The Progressive agent told me that I will be receiving a call from the Woodbridge office tomorrow morning, so hopefully I can get my MS3 back to normal by next week.

It'll be interesting what kind of response I get from D. Donahue when I tell him that I filed a claim through his insurance. Thanks again for everyone's insight on the matter. I've never had a bizzare case like this one, and your help means so much to me.

I'll post more updates as the situation progresses. *^_^*
 
I just want to say kudos on getting all the adequate information when your adrenaline had to be so high, I am impressed you wrote it all down and glad it served you in the end. Alls well that ends well.
 
go get a $100 pickup-truck and forget to break when you get to his house.

If you pay your deductable and have your company deal with his, it may save you some headache, though it will cost you some money up front.

Actually, as I see it, the fact that his family took your word for it reinforces my mental problem/drug use theory, as the family may be used to him doing stuff like this and having to cover for him.

Anyway, good luck working the rest of it out.
 
good choice, I wouldn't trust the guy to be honest especially after you chased him around town. I had a similar experience with a guy's dog attacking my beagle. I thought getting his driver license, telephone #, etc was good enough but I never found the guy.

I think you maybe onto something. I spoke to Ian from Progressive this morning. I repeated my testimony to him, so he could record it. Apparently he had already spoken to the witnesses before calling me since he knew their names and other details. I faxed him a copy of the police report, and I thought all was going well until he said... that they'll try to reach D. Donahue; however, if they can't hear his side of the story, Progressive might not pay me anything.

When I tried calling D. Donahue after that I got his voicemail right away which probably meant that the phone was turned off. I thought I'd try calling Mrs. Donahue in Ohio to see if she had a physical address for this guy. I appreciated how she was genuinely interested in my well-being. She told me that she might have a P.O. Box for Donny somewhere which she could attempt to locate if I gave her a few minutes. Interestingly she added (although I never asked) that, "Donny is the oldest, but he never acts his age. My other son, Alan, gets upset everytime we get pulled into whatever trouble Donny has caused."

I waited 10 minutes before calling her back. Unfortunately, she wasn't able to find the listing, but she was happy to share more of her family story: "when my husband was around, he used to take care of everything for Donny. He's spoiled; it's like he never grew up." I felt really badly for her because here was a 56 year old troublemaker running around in Virginia while his 82 year old mother in Ohio who was suffering from a degenerative disease, killing her eyesight, was having to deal with me. She seemed almost happy that she had someone to talk over the phone as she commented that I seemed like a nice person. I thanked her for her time and wished her for quick recovery.

I may hand the case over to my insurance after all, as I never imagined this to be such a headache. I mean... what more could they need? I have my banged up brand new car, eyewitnesses who are willing to testify, a police report, and even this guy's own family has no doubt about it. To say this whole experience has been frustrating would be quite an understatement. Paying $1,000+ isn't such a big deal to me(it's only money), but I am having a difficulty comprehending this guy's thought process, let alone the lukewarm cooperation of the insurance company in such a clear-cut case.

I'll just leave it up to God because I have no time to worry about this nonsense, and I have yet another wedding in three days (my friends). What's up with everyone getting married nowadays? *^_^*

Hang in there man. I think the important thing to note is that your car is going to be fixed. I wouldn't worry about the insurance company not paying - you've got witnesses and documented proof of the incident. Worst case your insurance is going to pay (-deductible), but your insurance co. should be able to get you reimbursed for everything.

It's never a fun process...

If his company won't pay you after they talk to him, have your ins. company take care of it, and they'll chase down or sue his company for the money. That's what you pay your premiums for after all, let them earn it. ;)

if u do anything to him...dont go to his property...he can shoot u...follow him to a store or something and trash his car...break all the windows and cut the valve stem on everytire....hit the hood in...smash the door panels in...you and 1 other friend could do this in 10 seconds and be gone...1 bat each and some good construction scissors that can cut the stem one clip...
 
yeah because thats the right way to handle it...seems to me that Hikaru9 is a bit more mature than that...
