Premature Clutch Failure in 2010 6 spd Man

Any updates?

well, never got to see the pictures they sent. and whoever they sent it to apparently said that the parts arent defective... Im trying to find a lawyer to help. Hopefully I can find one thats free unless I win(like Edgar Snyder although I dont believe he takes these kind of cases). Im also going to one of the news stations in Pittsburgh since I live relatively close. So far, I am just getting screwed more and more.
 
anyone know if theres a class action lawsuit?... or how to go about finding one? im trying to find a lawyer who deals with these kinda issues and its proving difficult so far(referral after referral)....trying to talk to a lawyer before i go to the news. will be doing that shortly.
 
Have you contacted Mazda Corp personally to hear for yourself that they received the pictures and made their decision? Personally at this point I would not trust this dealer at all.
 
i talked to customer assistance who said they are denying it... but i still have no proof they took pictures of my parts... im still working things out, nothing is going right, i havent been able to get a hold of the mechanics, someone to tow affordably, or any lawyers...regardless of whether i can make them pay for my clutch, im pretty much out to get that service manager fired for how he treated me and i want to know if theres any money damages i can receive for that(doesnt hurt to ask, im pretty much scarred for life from this experience...)
 
So here is a copy of the email i sent the local news station, i also called another one and they were VERY interested in what i had to say


My name is ________ _____, and I have been dealing with Baglier Mazda's service department for one month. My 2010 Mazda3 purchased in November broke down with 19,500 miles on it on July 11th in the middle of the night. The car was then towed to the dealership through Mazda Roadside assistance since it is the closest. I called the next morning to see how long it would be before my car could be looked at or repaired, warning them that I was pretty sure it was a clutch failure. I was told that they didn't know how long it would be until either would be accomplished, and it ended up taking 2-3 days before they could diagnose it. I was then told it was a smoked clutch and would not be covered under warranty(seeing as clutches are only covered 12k miles/12month), I said that there was no way that I caused this damage and that it had to be a defective part, and I was not going to pay for a defective clutch. I finally agreed for a tear down, and the parts were pulled out and the service manager informed me that they were not defective. I insisted on seeing the parts myself, which he did allow and he tried to tell me that the parts were evenly worn down and it couldn't possibly be due to a failure. I did not believe him, so after speaking with Corporate Customer Assistance, it was suggested that I take the parts to another dealership for a 2nd opinion. The parts were brought over to Monroeville Mazda, and within 5 minutes of seeing the parts the mechanic there agreed that they were defective, as the plate had uneven wearing causing the disc to shred. The mechanic told me that if the car had been brought into his dealership, that he would have it covered under the drivetrain warranty. After hearing this I called to speak to the service manger Dave Balash, who I ended up leaving two messages for and informed them that this was urgent that I needed to speak with him immediately. At this point my mother stopped over to see what was going on, she was told by Dave that he spoke with Monroeville and that they told him it would not be covered under warranty, and when I asked Monroeville if this was true, they informed me they never spoke with Dave and that they just got off the phone with Tom Dequilo(No idea how to spell his last name but that was how it sounded). The service manager at Monroeville told me that I needed to bring these parts back to Baglier so they could be inspected by Mazda. My Fiance and I then brought the parts back to Baglier, and while speaking with Dave, I told him what he said to my mother, he denied this and when I said he was lying to me he flipped out on me screaming that I need to pay the 175$ in labor fees and get myself and my car out of his shop. When I told him that I wasn't going to due this because the car was defective and I will not pay for repairs on a defective part, he yelled at me more saying I will not be getting my car back and to leave. The entire process was so traumatizing that I ended up falling to the ground in tears, unable to control myself and am now terrified to return to deal with this man. I returned to the dealership the next morning, to speak with the owner about the poor customer service, but was unable since he was in a meeting, Matthew Keene(new car sales manager) did speak with me and attempted to find out information for me(with little progress). I never heard back from the owner, and Mazda corporate seemed to have little interest in the events that had happened before that point as well. It had been decided, though, that pictures of the parts would be sent to the district manager and that engineers in New Jersey(I believe that is what they told me). I did agree to pictures being sent but Dave refused to let me, or even Matthew see the pictures. After the way he has treated me and has obviously lied to me at this point I do not trust that he sent pictures of my parts(not to mention you can't fully appreciate the damage on this clutch without having the parts in your hands). A few days after this incident I called Baglier for an update, they said they had no news and that someone was supposed to call me and have me call Customer Assistance(which no one did). I called Customer Assistance and was then informed that apparently Mazda was also going to deny my claim, even though their trained mechanics and every other mechanic I have shown pictures to, all agree that its defective. At that point I no longer know what to do, but decided to contact the news to see if there was anything you can do to help me, or at the very least, get my story out there so other people won't have the same treatment I have gotten from this. There are many other examples on the internet of other people having the same issues with their car, but most did not fight as much as I am trying, and the ones who are, I don't know how to get in contact with them. I have included pictures of my parts, some were not zoomed out far enough to give a full view(the pressure plate), but it still shows defectiveness. I completely support your goal to "go after" (for a lack of better term) Mazda and your dealership like this. Not that I know you dealership, but I've been treated the exact same way by my local dealership's service manager and was threatened cops on me after they wouldn't explain why my entire engine failed.

I think a BBB complaint is in order if you haven't done so already, it'll at least spread the word more about your dilemma and maybe they'll throw some scare into them a little bit. I wish you good luck sir and hope the news can at least put your story out there for other people to hear and be weary of these problems.

(My service manager was let go shortly after my dealings with him fyi, so there can be justice in other forms(headbang))
 
Wow! This is crazy! I live in Ohio, but my Dealership is Moon Township Mazda (Right next to Pittsburgh IAP). I have not delt with them , yet. I am taking my car on the 19th to have the power steering pump replaced because it was recalled. You have me scared, and I hope this never happens to my mazda. Keep us updated! If you wanna post the number to that mazda dealership I'll call and tell them they were going to have my Bussiness until I read this online, hopefully that will p*$# them off. =]

haha yeah that dealership is way far away so i have no idea what they are like, but you calling baglier would be hysterical.

I did contact the BBB the other day though, turns out they can mediate this whole ordeal and mazda may just outright call me and settle before it gets to mediation... so im kinda excited, thanks for the suggestion i had no idea that they were capable of being as helpful... the number for baglier mazda is +17247722666 if anyone is interested;)
 
okay guys so where should i get the parts from... im stuck doing the repair, and having to wait to get reimbursed(if i win), got a call today from the dealershit telling me they are going to start charging me 25 dollars a day lot fees starting monday(which is a holiday?) *facepalm*

BBB contacted Mazda, Mazda said No it was Driver error, and now i have to get the car repaired to get any further with the BBB. shoot me now please.


edit -ive tried looking, noone so far knows of any aftermarket for the 2.5....all they seem to know is its a 10 inch clutch...but i have KYclutch saying they can rebuild for around 100 dollars, worth it? or just get the parts from the dealer?

Take a leap of faith and order a aftermarket 04-09 MZ3 flywheel and clutch :)

The clutch disk, release fork, and pilot bearing share the same part number as the gen1.

The flywheel and pressure plate/clutch cover are the only parts that have a p# unique to the 2010+ 6spd.

It might be worth a try?!?!?
 
hey guys once more, so i am getting the pieces rebuilt through kentucky clutch, but before i sent the parts off, i took a bunch of detailed pictures...

Let me know what you guys think, I am going to go to the local magistrate today and see if they can help me sue Baglier for repayment.
In my honest opinion i think the flywheel has pretty normal wear and tear but the clutch disc and the pressure plate are f'ed up id say. You can REALLY see clear pictures of what the mechanic described to me as flaking on the pressure plate which he said was defective. if any licensed mechanics can give me their opinion i would be greatful=)
 
Good luck with your car, I have seen 2 newer 3's with 2.5 have clutch concerns, but always from the customers driving habitsto be related to. Both were cutomer pay but the customer knew what they had done
 
I'd love to hear an update. I have just bought a used 2010 2.5L 6 Speed with 42,500 miles on it.

The clutch feels ok and the car has been driving well. Clutch engages a little weird...feel like it begins to grab low on the pedal but not fully engaged until up high on the pedal. Further more during rev match down shifts....feels like the clutch doesnt grab till up top.

But even the same night i bought the car; I was having issues getting it into first gear when at a stop and it was difficult getting into second gear. Seemed to be when the car was at operating temperature. I was thinking shift linkage; but the service writer said they believe it to be the syncros since 3 through 6 feel fabulous. As a result; I'm about to get a new transmission next week since syncro's are covered under 60,000 mile powertrain.

Really want to know how you have made out. Thinking about sending this thread to the service manager to let him see some of these issues for future owners.
