My MSP damaged at time of sale!

Hey guys, I recently bought my MSP from Anaheim Mazda in California and had it shipped to me in Atlanta. The car had a few damages to it before it was shipped to me: The right rear bumper was loose (where the 2 sided tape is) and the right rear rim was damaged on the outside edge (along with a small slash in the tire adjacent to the area of the rim that was damaged. I've managed to get the bumper fixed under warranty but the rim damage is still there. One user on this forum, Oldasdrit, also bought his MSP from Anaheim Mazda and he saw the yellow one I bought while it was there and pointed out the damage to them and he said the sales rep he spoke with said it was no big deal. Now I've been on the phone with 2 of the sales managers there and they're denying the damage was there and also that the rim isn't a warrantied item. Additionally, I just got off the phone with Mazda USA's Customer Care center and they're saying they can't do anything because they are just a third party and that it would be a civil case between myself and Anaheim Mazda. Now the car had 120 miles on it when I bought it so quite likely someone who test drove it hit a curb or something, but I just don't see why I should be stuck with it. Now it seems like they'll get away with it. The only thing I can do now is fill out a very poor sales survery for the dealer but it's not like anything will be done anyway. Anyone have any suggestions?
 
Did you get a pre-sale damage report in writing?

When I took delivery, there was a scratch on the trunk lid. I pointed it out, the sales manager wrote it down on one of the contract papers and we both signed it. I brought it back a week later at my convenience, told them what happened, they initially refused. I showed it to them in writing, and they immediately buffed it out. (Some people probably would have immediately began yelling when they said they won't do it for free....but they were just doing their jobs, and did not know that the sales manager and I signed the agreement)

I hate to say it, but if you don't have it in writing, you have little chance of getting it fixed.

Geta lawyer ( pre-paid legal is cheap ) and also call the better buisness bureau and file a complaint. They will actually send them a letter about complaint. A lawyer is a must or buy another rim and don't do anything.
 
Mine had a small dent in the passenger door. They fixed it no questions asked.
 
Go to keystone and have them fix it for 125$. Like they said, not worth the hassle of legal action.
 
speaking of which, I need to fix my rim or buy another one...anybody selling one 03.5 rim for cheap?
 
I have already replaced a couple of curbed wheels on my car very cheap buying from forum members. I am having 2 replaced through insurance now and they are paying $510 apiece for them!

I bought 4 wheels and factory tires with 2500 miles on them for 450 bucks! Just thought I would share.
 
Thanks for all the input guys. I don't think I'll be taking legal action at all. I'd probably spend more money paying for the legal work anyway. I'll just let my feelings known in the customer care survey.
 
sorry i didnt get back to on the weekend, I think
the sale peep i talk to when i was there was Matt can
not rember his last name that what happen when u get old as dirt . It piss me off because i saw that dam mark on the rim when it was on there show room floor . I wish i could have talk to before u pick up the car.
 
Mine was damaged at the time of sale too. Both bumper lips falling off. I had them worked on under warranty. I'm not happy with the result though and will be going back. Also, I had a nice dent in the passenger side door and a little chunk taken out of the side skirt. Not noteciable unless you are close. Both are fixed now after a little fenderbender I had.
Finally, and here's the kicker.... A window was broken and fixed on this car prior to me buying it. Salesperson told me it was one of those triangle windows on the back door and I have found some glass bits on the floor while vaccuming. But, when I went in for my amp rattling against the frame in the trunk they told me it was wired in there with aftermarked speaker wire as if someone had removed it. We took a look behind the radio and the original wires are cut and it's hooked in with aftermarket wiring.

Now I'm thinking my car was the unfortunate victim of a radio theft long before I purchased it. Luckily, everything seems to be working nicely and that's all I care about. :)
