I got into a accident in my protege im not going to write what happen that will be to long. we'll say that i was not at fault in the case. My question is why and what i should do if the guy at fault insurance company called my insurance co. They asked if a claim had been filled. which problem means there going to fill a claim and seek damages. I don't want my insurance paying for anything because i feel he shouldn't be awarded any money from me or my insurance. Not to mention my insurance co is having to investigate who is at fault now. All this because some moron wants to manipulate the system. what should i do?

what is your state? each state differs.

was there damage done to his car?

And yeah most importantly what does the police report say?
 
I'm in CA yea i had a police report i just got it today the summary say he had broken certain codes and which i believe clear states he is at fault.
 
Alrighty.. Well if that's the case, give the police report to your insurance company, and they'll sort it out.
 
your ins co will pull the police report anyways. put it this way - your insurance company isn't going to pay any money it doesn't have to. let them try to file a claim against your insurance company. if he's at fault your company will then say no. if they want to pursue they then take it to arbitration and eventually can end up in court. the ins co will take care of all of this and contact you when they need more information. let them do their job and don't worry about it. that's part of why you pay for insurance.


what does suck, however, is that it is possible for rates to go up even when it is found that you are not at fault for a claim and the ins co ends up paying no money. depends on your state laws and the individual ins co but it is possible.
