Rodent damage on new MS3

If they are actually passing off your used trade-in as new, then that is a crime, and should be reported. I would think they'd have to commit odometer fraud as well to fool anyone into buying it as new, though. Are you absolutely certain they are selling it as new? I can imagine a local used car dealer messing with odometers, but I would hope the chances of a major brand franchise wouldn't be so blatantly stupid & underhanded.
 
Thanks to everyone for sharing your 2 cents. I appreciate your input. I'm still not sure if I'm going to do anything further about it (report to DMV vs. complain to Mazda)

I understand that the damage was not their fault, but I felt they could have handled the situation much better. The things that still bother me about the situation:
1) not a single person in the dealership said anything like i'm sorry you had to deal with this mess
2) they broke the law. they put a new NY inspection sticker on a car they never inspected. in principle, this is really bad. many wires were destroyed under my car- some going to my radiator fan, transmission, etc. The tech told me I might have overheated. Perhaps someone else could be injured if this happens again in the future.
3) $100 is not enough to compensate me all the time I wasted. I lost money in the deal
4) They are selling my old, chewed car as new now on their lot! How messed up is that?

All I wanted was my new MS3 without all this headache. If they would have been nicer, more accommodating, and willing to actually make up for my lost time I'd be a little happier. I can't believe that stealership is going to sell that other car to someone else.... Whatever. I love my MS3

No they arent. No dealership would be stupid enough to pull a move like that. how exactly would they hide the fact it already has plates, and probably several thousand miles? And it was registered under your name.
They legally cant sell a used car, as new.
 
I'm pretty sure they are selling the chewed car as new. I've been checking the dealer inventory on mazdausa.com, and this car with matching VIN# was first removed when I bought it, and then put back in their inventory recently.

I think the reason they can get away with it is that: 1) It only had 531 miles when I returned it (I only had it for 5 days). 2) They stopped the title/registration application before it was completed. So "technically" it was never owned by anyone else- but.... man it's super f'd up. It is possible that they will tell a future owner about what happened- but I highly doubt it seeing how poorly they treated me in the first place.

So should I contact Mazda first?

Yeah to save the person buying the thing a mess of troubles I would contact Mazda USA.

I think legally it has to be listed as a Buy Back

I just got off the phone with Mazda USA. I told them the whole story so they could document it. They said that the dealership may actually be able to legally sell the car as new depending on state laws because it was never registered/titled in my name (for example if it has <600 miles). The guy on the phone was also surprised that they gave me a replacement car instead of just fixing the chewed one. He said I should be happy that they did this, despite the measly compensation they gave me.

So that's as far as I'm taking it. I won't report it to the DMV. THey'll have enough issues because of my complaint. I just feel really bad for whomever buys my old car.
 
dude, you keep crying about your "compensation", seriously? its time to get over it. I think they went WAY beyond what most dealers would have done by giving you a brand new car. Mazda is right, most would have just fixed the damn thing....what else should you be compensated for?!?!?!

sounds like you were trying to take advantage of Mazda to be honest. They went above and beyond by giving you a whole new car. That's customer service at its best, despite your first purchase being low miles. Most dealers would fix the car leaving you with serious down-time. It was an unfortunate event BUT you got the best possible outcome.
 
Personally, I wouldn't have taken it back if they had just fixed it, I would have requested a full refund for the vehicle. Then again, I think what they did was mere compensation for them not abiding by the laws and the $100 was a please don't report us clause. $100 doesn't seem nearly enought but as long as it's on file with Mazda NA then they'll have enough problems form there and I would just leave it.
 
Sorry to hear about your pains, but at least you got what you deserved; A BRAND NEW REPLACEMENT MS3.

The dealerships will always point their fingers at you for anything that goes wrong to the vehicle once it leaves their lot.
You should of rev'd the engine up and roasted that bastard! lol
