From the report of the adjuster who did the work for the arbitration board.
1) Yes the transmission has been replaced.
2) Yes I was able to duplicate the shifting from 5th to reverse.
3) Tommy has mentioned a redesign to the lock out plate and spring assembly, a check of the serial number and research would be carried out to see if the new transmission has these updates. It would still appear that the lock out of this transmission has faulted in comparison to the dealer supplied test vehicle.
4) The consumer does not appear to be abusive in his driving of the vehicle, the vehicle is clean and he appears quite conscientious in it's overall treatment (locks vehicle eveytime he steps away, even at the dealer), places vehicle in gear and sets handbrake before shutting off vehicle and exiting).
