my MSP vandalized??

Last night when leaving work(Lowe's home improvement) I found 2 shopping carts slammed into the trunk of my car. They hit so hard it dented the trunk and set off my alarm(which isn't that sensitive). I'm curious as to whether the wind somehow manages to find 2 shopping carts left in the parking lot and push them directly straight across at least one lane into my car, or if someone vandalized it. We have signs on our cart returns saying we are not responsible for damage done to cars, and asks customers to use the cart return to prevent such accidents. Well this happened sometime in the middle of the night between I'd say 2am and 5am. Do you think there is anyway the store could be held liable for the damage? I'll try to get pics later after I wash it, but I'm just wondering if I'm gonna have to put out the money for the deductible($500). Any of you have a similar experience?
 
My Mom's Protege was hit with a basket in a parking lot. She tried to contact the owner of the store who did the "we are not to be held liable" thing and she left it at that. I wanted to push the issue however, since that, to me, is like those trucks with "not responsible for broken windows" stickers all over them, when in fact they *are* responsible for them legally.
 
I'm gonna go talk to them about it right now, but this is what I'm questioning...
It wasn't during store hours and those carts are ALL supposed to be inside before the store closes. Isn't that neglect on the stores part? And I wasn't shopping, I was there for work if that makes a difference.
If I can prove it was actually vandalized(we have survailance), do I still have to pay the $500 deductible if I can't find who did it?
 
That sucks, Alex. Hopefully, it's not too bad.

It's kind hard to get good pics of this color paint, and my camera is only a 3.1mp, but to me this is pretty significant damage. Especially when I think of how much it'll end up costing to fix. 2 years of no dings or major scratches then this...:(
I know it was windy, but something just tells me not to accept that yet. If you saw where my car was parked, it's almost unimaginable that two carts stuck together could have gone as far as they did and hit my car dead on.

If you can find an attorney that will disucss if with you without charge, I'd say do that. I'm not sure of any legal aspects of this. It all depends on how much time you want to put in to it.
 
well i work for a grocery store and we have the same signs but when people come in and complain they always take care of it anyways cause they want the customer happy
 
Hey Brother, sorry to hear about your loss. I too work for Lowe's Home Improvement Warehouse, but in the Pittsburgh, PA area. I totally agree with what you are saying about the corporation being held responsible, but i also agree with you saying it was after store hours and that all carts are supposed to be in doors. Talk to your Op. Manager and Store manager hopefully something could be worked out. Its funny because about 4 years ago my brother's S10 was hit by a flower cart loaded with soaking wet flowers from a had downpour. The cart gained monentum going down a 50 yard grade nailing the pass. side front fender. Lowe's paid for everything, but at the same time was a flower cart, not a red shopping cart. Good Luck
