Mazda Dealer glued my transmission back together!!

I brought my 2004 MX5 mazdaspeed (with 28K) to the Toady Mazda Lincoln Mercury in Oxnard, CA here about a year and a half ago just before the warranty ended. I had been smelling some burning oil/exhaust after driving the car hard. They took a look and told me that the rear seal on the rear of the trans was bad and they replaced it. I went happily on my way until a month ago when i started noticing the smell again. This time I took the car to a good private mechanic. He took a look and then called me to come over. We put the car up on the lift and to my surprise he showed me the rear of the transmission near the replaced seal. It had been cracked and then glued back together with something like JB Weld epoxy. Unbelievable! I called the dealership and of course they denied doing this. They claimed it had been done before they had seen the car (which had come from a now defunct dealer). I asked if this was done before why hadn't they told me about it. The dealer service manager said that the glue was an authorized Mazda repair and they wouldn't have said anything to me because the problem had been fixed. So 1. either the either the dealer broke the trans, glued it together, and then lied, or 2. Mazda officially fixed my car by gluing the trans back together. In either case this is shoddy treatment and calls into question the integrity of Mazda's service and warranty. Here is a pic of the trans:

Mazda USA refused to look at the car, saying it was up to the dealer. So beware of Mazd's repair work - make sure to carefully look over anything done to your car while it is under warranty. The car is being fixed now by my mechanic to the tune of $1300 - good news is that it will be perfect when I get it back.
