I really love how anyone can determine oil as the root cause of an issue without taking a sample and analysis in addition to a complete tear down and inspection to determine what broke and why.

So they finally admitted that my turbo is broken and that it is causing the smoking. However, I have not had my oil changes performed at the dealership and have done them myself. Evidently this is grounds for voiding my warranty and not performing the repairs. I am trying to find all my oil receipts and have been told that even if I manage to do so it may not be sufficient to avoid having my claim refused. I have 23,000 miles on the clock and have had the issue since day one. I have had it in several times before that they denied and now they are trying to take a different approach at not helping me. Bull sh*t. The dealer is Luther Mazda in Brooklyn Park, MN. Any other bad experiences?

i've been on and off of the phone with the service writers at galpin mazda (roscoe and the 405 socal) to find out what would void warranty. they are very helpful and it seems as though they are lenient as well.
last time i called, i specifically asked about test pipe, and they said, ok...but if problems are caused by changing the test pipe, then void warranty on those specific parts of the vehicle. NOT the entire warranty.
call a few different dealerships and ask them specifically about your mods and whether or not they will fulfill the warranty.
putting the stock dp back on might be beneficial to you as well for when you take it in, but you can ask about this when you call the dealerships
If anything, so far I have learned that your continued relationship (or not) with a dealer and service department means a lot in how you will be treated when it comes to having work done. That said, mazda does require photos be submitted of the vehicle and area of work for any repairs to be authorized. My interpretation of that is remove any and all aftermarket parts. Might as well not give them ammunition when it's decision time.
The MS3's can't use under a certain viscosity otherwise the oil can make it past the turbo seals and cause issues. One of the side-effects is smoke. I believe 5W30 is the minimum viscosity, but don't quote me. This is what the master mechanic at my Mazda Dealer told me when I asked him about the turbo seal problem.

Good advice seriously and..... wait for it............... +1I'd try Morrie's in Minnetonka. They seem to be much less hostile towards mods. I have never been to luther, but I've alternately heard good and bad things about their service so I've just stayed away from them. I'd avoid Walser also.... unless you're going in for a routine oil change, their service department seems iffy at best.

What I'm saying is that the law is one thing but getting the dealership to follow it is another. At the end of the day, they (or MazdaUSA) are the ones denying you service that you need and if you don't agree with their denial, you can't exactly call the police and force them... You have to take them to court, where you and your lawyer (if you even have one) will be pitted against a corporate lawyer with all the tricks to prove negligence or abuse on your part thus defeating you and costing you $texas in the process while still not getting your car fixed.
Your best bet is to take it to another dealership.
ok so, heres the story as goes
i have a 05 mazda 3 hatch. its lowered on eibach's with a 2.5' custom catback. i was driving to work the other day, hit a slick spot in the road where it had rained, lost traction and heard a loud crash, right after, i ran over something. looked back, to see what it was, thought it was just a piece of wood. as soon as i pulled into a parking lot, the car died. first thing i thought was "oh s***"
so i got out of the car, popped the hood, and my motor was leaning on the chassis on the left side. first thing i thought, "bad mazda motor/tranny mounts". man was i right. so i called roadside assistance, they were nice of course, and helped me out. tow truck came up and as he started rolling it up, i noticed something. my left cv axle came completely out of my transmission. you can imagine how pissed i truly was.
as soon as it got to the dealership they called me, telling me that they would check it out and tell me the cause of the problem. i couldnt be there cuz i work 60 hour weeks at my job. well bout 5 hours go by and they call and tell me it may not be covered under the warranty, they were concerned for abuse of the car and they wanted to tear down the transmission, to look at the clutch. now they explained that if it was covered under warranty, there would be no charge, but if it wasnt, they would charge me 500$ on top of fixing the vehicle. of course i gave them the ok, thinking there would be no problems. a day goes by, they call me telling me they wouldnt cover it due to the suspension and they said they found hot spots on my clutch disk and rivets on the pressure plate. they also said that the condition of the clutch would be normal wear of a clutch that had 70k miles on it. i have a little over 22k on mine. (bought it in may, how sad)
so now i begin to freak, they give me the estimate of everything that needs to be replaced. the transmission, cv axle, motor mount (of course), and probably the wiring harness all for 5600$. and all of this will not be covered under warranty. now i work at Hibdon Tires Plus, and for those of you who dont know what that is, we pretty much do anything from tires, to tune ups, to some deep engine work plus all of the suspension parts. so i know what the hell to look for, and what goes wrong. and if i dont, my technician does. hes told me that nothing ive done to the car could cause what happened.
i need some help, maybe some advise. would anything ive done to the car, as far as suspension or maybe even shifting hard (i dont even shift hard) cause what happened to this mount?
Edit: just as an update, i went to the dealership to give them paperwork that i had from a while back. it was a reciept from reynolds mazda that i had gotten an oil change and complained about about a broken motor mount back in june i think of 05, i hadent lowered the car til, october. it also said that they test drove the car but they didnt find any problems at the time. yet the mileage said "in: 3091 out: 3091"
also when i went up there, they said that i was racing because of my "exhaust" which is a cat back (not voiding warranty) and i had "wider tires" (i went from a 205/50/17 to a 215/45/17 cuz it was a more available, cheaper size)
now the district manager is coming down the 19th. and they refuse to give me an enterprise rental car till then til they can prove it is a warranty issue. am i getting ***** or what? :ky:
