Here in Australia we have a law that provides whats called a “statutory warranty” which would cover this issue for sure. Regardless of the age or mileage.
The statutory warranty, also known as a consumer guarantee, is an implied promise that goods or services are of acceptable quality and meet certain standards. This warranty applies regardless of whether the retailer or supplier provides an additional warranty, and consumers can seek remedies if the product or service fails to meet the guarantee.
An example of this law in action is the problem Mitsubishi had with the MN series (2009-2015) Triton engine, that suffered from porous engine blocks that eventually cause blown head gaskets and overheating. Mitsubishi didnt recall them, but have been forced to replace them for many years now and still do even today (largely) free of charge as its a known manufacturing fault.
The same guarantee applied to the early Mazda 2.2 diesel engines in CX5 and Mazda 6 that had failures. My brother had his CX5 diesel engine replaced at 90,000km FOC by Mazda when it was about 3 years out of Mazda warranty. He didn’t even have to invoke the statutory warranty, Mazda knew it would have to be covered and addressed it without question.
