1st speeding ticket, help

Got caught in a speed trap today, clocked at 100 in 55 zone, but the cop said I was lucky he was having a good day, so he wrote me for 79. Now $140 and 6 points later, I don't know whats next. First I mail the ticket off with my cc # to pay it right? So how do I lower those points? The online traffic school says I need permission from a court clerk or a judge, which means I have to plea not-guilty and goto court right? But if I plea not guilty why do I send payment for the ticket? What happens when I take a regular old traffic school course anyway? Do I have to bring proof of passing the course to the dmv, and mail it to my insurance company as well?

I would prefer not to goto court, as here in suffolk its a TVB court, I've heard ppl saying fighting there is next to impossible. I just wanna pay what I owe, and lower my points as much as possible. How do I do this?

By doing that (paying and not showing up), you can't plea not-guilty and you cannot lower your points other than letting them ride out over time. I can't remember the exact numbers, but you get one point back every year or something like that.

Oh yeah, and you're the kind of driver that pisses me off, 100 is totally uncalled for in a 55, that is just plain dangerous.

Finally something Im an expert in Ive been pulled over 6 times and I live here in new york. go to WWW.AAA.COM they offer safe driver classes which will take away I think its 3 points its 55 bucks and it also lowers ur insurance

if you plead not guilty the DA will almost always reduce the charge so it won't go to trial wasting his time. your 6 point ticket will probably be reduced to a 4 pointer. if the DA isn't there when you go in for the court date on the ticket then they will schedule another date for you when he will be there. so plead not guilty and take the DA's deal when it is offered.

its pretty clear you have never driven in or around new york city I have been in the slow lane between 80 and 90 mph and thats just because I didnt want to get run over maybe in north country people drive the speed limit but here in new york you drive as fast as everyone else does. plain and simple going 55 when traffic is moving 80 is more dangerous than going 80 and flowing with traffic

I have to correct myself, did some research, you can take the courses and such in WI, and you can't get more than 12 points in 12 months.

As for preopstud's comment, I hope I never have to drive there! I'm ok with speeding, but 45 over is a bit too much in my book.

6 points!!! thats quite alot even for 20 over. Here in NJ they generlaly only give you 5points for that but they can also give you reckless driving tickets to boot. I have alot of experience with tickets unfortunately and I would definately attempt to fight it. Worse comes to worse you get it delayed and lose or you win and get less points. However they generally will hit you with steeper fines when they lower your points.

Illinois doesnt really use the point system, so I cant help you much
but where I live if you are not doing atleast 80mph your going to get your ass run over.
And its a huge pain when some clown from up north sits at 55 in the far left lane and wont move over for faster traffic.

I agree also. You pose a great danger to yourself and others around you. That was a selfish and dangerous act. Hope you've learned your lesson and suck up the punishment like a man. You desereved it.

You're guilty. Pay the ticket and take it as a lesson learned. I'm always amazed how people try to wiggle themselves out of positions they put themselves in. Maybe I sound a little coarse and unsympathetic, but you have to accept responsibility and the consequences of your actions...be an adult.

Everyone seems to think the ol "cop not showing up" crap is a common occurence. The fact is it is not. Cops actually get reprimanded for missing their court dates. If it affects their job and possibly their raises, you can bet they're not gonna miss it 99% of the time. Continuances can also be a source of aggravation for a Judge...they know all the tactics. Go or don't...but don't delay the inevitable. You'll feel better once it's all done.

You can voluntarily take a driver improvement course before your court date. When your case gets called...acknowledge your error and show you've taken corrective measures. Hope the Judge is more sympathetic. It's possible to get some of the points and fines lowered with a sympathetic Judge, but don't expect it.

Call the # on the ticket (the court) and tell them you want the # to the DA office. Call them, and tell them you want the ticked deferred. Since it's your first, it should be easy. What they sometimes do is basically put you on something like a probation. If you don't get anymore tickets during that probation period (3 - 6 months), then they throw your old ticket out, and no one finds out.

If you want to take the driving school, you have to do virtually the same thing. Call the court, let them know. (you have to have their permission). That's why the trooper reduced the speed on the ticket, so that you can do that. Usually if you break the speed limit by 25mph or more, you don't have that option to request driving school, so he put 79 on the ticket so that you'd be within the limit. but you HAVE to ask the court first if it's ok.

i got off two tickets over the past years. ones just got waved in MA and the one I got in NH, I had to take a driving class, which ended up being skid school. i had already mastered that class screwing around every winter in the snow covered roads and p-lots.


the tickets were going 82 in a 55 during traffic time in NH and 80 in a 65 in MA. judjes were cool.....got in trouble. have to get back to work

Don't listen to them. You are not guilty! You are innocent until proven guilty. You can do a few things. #1 fight it. The cop has to calibrate his gun all the time, record it, make sure that the speed he wrote you on the ticket is exactly accurate. Guess what he changed that speed. What he wrote will differ from the log (if he wasnt lieing), therefore it is like a million times easier to get off! I dont know about NYC but in Florida i fought every ticket i got, 2 i got dismissed and 1 i got ajudication withheld. What sux about postponing court here is, that in Palm Beach County, the cop doesnt have to show up anymore. The ticket acts as enuf evidence for him not to have to be there. #2 YOu can pay the ticket and take the course (the least intellgent thing to do) #3 You can pay the ticket, but when you pay the ticket overpay it by like 10 bucks. The county will send a check back to you for the 10 bucks, but never cash it. If on their record you havent cashed it, they can't issue points until all financial aspects are over.
Don't worry, it is just a ticket. There will be others, and maybe bigger ones.

i agree he is not guilty until proven but he has to fight it. the judge will not be happy with his excess speed........maybe the police man will not show up, but i bet he will with this high speed????

Ok... I would definetly try to fight the ticket. You would be stupid not to. Just make sure it is worth your while. However, if you get a stiff judge, be prepared to pay and face your own decisions.
