CP-E Xcel Nano question

I have an 09 Speed3 with a CP-E Xcel Nano and ever since I put that in, the engine cover has not fit on properly. I can bolt it down but the piece on the right side of it that covers the tubes is bent slightly upwards because of the tube the goes into the intake (I dont know what that tube is for). This is causing that part of the engine cover to rub against a foam piece on the underside of the hood and wearing away the foam. Because of this, I ended up removing the engine cover. Has anyone else had the same issue with the CP-E intake?
