How to get Mazda to pay for my blown engine.

I have a 2006 Speed6 with just under 20K miles on it. The only mods that were done to this car (done before I purchsed the car) are:
AEM intake
HKS blow off valve.
Magna FLow Cat back exhaust.


The car threw a rod threw the block and the tranny.

I have the car towed off the highway by AAA to the nearest Speed dealership.

The dealership puts the car on the ECU computer and the service managers tells me this. "Your car was traveling at 72 MPH in 6th gear with the cruise control on at 3200 RPM, and the code the computer has in it at time of engine failure is Over boost" How can this car at 3200 RPM Over boost??? In any case the service Mgr. tells me he has to call the Mazda tech hotline to see if they are gong to pay for this claim. I was like what the - - - -? Why would we need them to approve a claim for a car that is clearly under MFG Warrenty? He tells me that this is standard protocol due to the amount of the repairs. ($14,000). He gets this tech guy on the phone and then sends him the computer infor from my car. The tech guy then denies my warrenty claim for the reason of "to many mods and over boosting of the turbo". I am at at total loss here and i'm asking if anyone else has had this problem from Mazda and "HOW - TO" deal with it.

I have also showed the dealership the following law:

The Magnuson-Moss Warranty Act (15 U.S.C. 2302(C))

This federal law regulates warranties for the protection of consumers. The essence of the law concerning aftermarket auto parts is that a vehicle manufacturer may not condition a written or implied warranty on the consumers using parts or services which are identified by brand, trade, or corporate name (such as the vehicle maker's brand) unless the parts or service are provided free of charge. The law means that the use of an aftermarket part alone is not cause for denying the warranty. However, the law's protection does not extend to aftermarket parts in situations where such parts actually caused the damage being claimed under the warranty. Further, consumers are advised to be aware of any specific terms or conditions stated in the warranty which may result in its being voided. The law states in relevant part:

No warrantor of a consumer product may condition his written or implied warranty of such product on the consumers using, in connection with such product, any article or service (other than article or service provided without charge under the terms of the warranty) which is identified by brand, trade or corporate name... and they state that they can not provide me with the details of the denied warrenty claim.

I really wish you people would quit using th Magnusson Moss act..Its a joke and will never win you warranty work.
Period.


And My only question is...Was the boost at stock level with the above mods..If so..Then they should replace the motor...none of those mods shoul or would cause failure in the engine like this.
 
Things like this make me want to sell my car.

Someone chime in here and confirm or deny this: When a car throws a CEL, or something, doesnt it make like a list of the values of the most important sensors - so if it throws a light for overboost, shouldn't it read and record the MAP sensor voltage?

You made the mods you took the chance, you blew your engine and you have nothing to stand on.........sucks but that's what happens when you bend the rules. I wish it wasn't so but imagine you being the owner of Mazda and this kid comes in your shop and he has mods on it and you have to pay for a blown engine.....you would probably say I cannot stay in business if I am fixing cars all the time for free when I cannot control the setup of the car. Anyway, that law was created to stop dealers from blackballing specific brand names. It does not cover warranty issues from neglect related to the addition of high performance mods.

Bottom line, Mazda has the right to claim your mods are the cause but they cannot tell you a specific brand name, trade or corporate name mod is a standard cause. In layman’s terms......"Mazda can say your blow out valve did it, they cannot say that Greddy blow out valves are always the cause for this type if engine failure”.

Sorry, but I have realized the only way to mod a car, if it has a warranty, is to take full responsibility of the car. You must understand that you make changes/mods to the car, you will no longer have a warranty or a leg to stand on if you try to fight the car manufacturers/dealers. You will be responsible for all repairs on the car as if it never had a warranty. Some people do get lucky and scam their way through the warranty/repair with mods issue and they have a good story to tell when they do (so they think).

Suck it up be responsible and buy another engine unless you like your new lawn ornament. If you can scam your way through this and get the engine replaced, I must thank you for screwing the world and me by making cars more expensive while we loose leverage with dealers regarding repairs because we instantly walk into a situation where we are doubted when trying to get legit warranty repair work completed. You are a true road scholar!(cool)(wiggle)

Remember this.....if you have a warranty and would like to use it check with the dealer before making mods. If you have a friend in a dealer and he will fix your car after you make mods remember he may not work there during the entire life of your cars warranty. I have asked Mazda people a thousand times if I could have a blow out valve. Every Mazda person I have asked told me (with vigor) it would void your entire warranty. Don't listen to your friends regarding this do not listen to the guy that has a real cool car that beats everyone ask the source that will determine what will occur and we all know who that is………it’s the manufacturer….doesn’t that just suck balls?

so i think he bought the car used, and the previous owner put the mods on, then returned it to the dealer.

if that is the case, mazda should cover the warranty!!!

umm... what???

with your logic, I could buy a new car, mod it all to hell, void my warranty... but as soon as I sold the car, the warranty would magically reappear?
 
i know a guy who bought an rsx from the dealer modded including a chipped ecu and he blew the engine. dealer denied warranty but he took them to court and got a brand new engine
 
This is so ridiculous...obviously the dealer can void for any mod, and I don't fault them for that, but they clearly are just looking for reasons to void warranties instead of fairly considering each claim. Sorry you're out the dough, check with Ken at Protege Garage and see if he can help you out.

I don't really know what to say. This situation sucks and Mazda know what they were giving you when they sold you the car. unfortunately Changing the integrity of the vehicle in any shape form or fashion can deny you warranty work .

I would first save up some money and buy yourself a motor return it to stock and enjoying it.

Do we know if he bought it from a Mazda dealership, with those mods, and if so, was a warranty expressed at the time of purchase?

I wish you wouldn't open your trap when you have no idea what you are talking about. It worked for me on my Acura Tranny. They put a whole new trans and clutch in my 99 GSR because I got an attorney to write a letter and quote the MM Act and requested they PROOVE how my mods could have caused the failure.

And My only question is...Was the boost at stock level with the above mods..If so..Then they should replace the motor...none of those mods shoul or would cause failure in the engine like this.

It was not purchased from a Mazda dealership, however the dealership where I purchased the car knew I would not purchase this car if it was not in Manufactures warrenty. They pulled up Mazda's website while I was in the dealership and put the VIN number in and showed me that this car was till under full warrenty. The link below is the add on Ebay that helped me located the car and if you read carefully you will see that they advertise the car still being in manufacturs warrenty.

Keep in mind that this car does have an after market boost gage that was not put on by me so I can not guarantee it's accuracy.
Since I've owned the car and from the first test drive the car has NEVER been past 12 PSI. During hard acceleration it will hit 12 PSI and boost creep back and hold steady at 10 PSI according to the boost gage that was already installed prior to me buying the car.

I am reading that the stock boost level of this car 100% stock off the showroom floor should be 15 PSI.
