Mazda's Warantee Clause and Voiding Issues.

yep,

so you know what - who cares

Don't break your car, if you are afraid you are going to break it - don't modify it. If you trust the people working on your car ( like I trust Nick(Perfworks) and Nick (his partner) at Modern Performance, then you don't worry about breaking it.

Worse comes to worse, s*** hits the fan, you ******* fix it, if you can't afford to fix it, you buy a beater and drive that until you can.

It is not the actual fact that I even want some Mazda service tech working on my car and fixing it for free. It is the principle of it! A ******* aftermarket car alarm void a warranty for the engine?? That is just bull! The whole warranty blown because you want to protect your car better. That is crap!

Then I suggest being friendly to the service/parts department or finding a new dealer. Also, if you're unsure about modifications have the dealer install them for you. This traditionally makes justification of the warranty clause a bit easier if the voiding item was installed by the dealer that is now refusing to service the vehicle.

Plus, I always hold onto all receipts/paperwork of aftermarket items and ensure the original (replaced item) remains in the identical condition it was in prior to install.

I actually have to make a warranty claim on a warped brake rotor this weekend and have an aftermarket exhaust installed, we'll see what this causes.

Yeah, but the fact that they have it in writing makes it a lost case. Sorry, but I don't care what anyone says. When they have a warranty void clause in the paperwork....well, you are just SOL

Well that is not completely accurate. Just because someone writes something down on paper, doesn't mean that it is automatically legally binding. It is more or less a scare tactic created to fool the uninformed into not making claims, thus saving them money. For example; have you ever ridden behind one of those big as dump trucks that have that sign on the back that says "Not responsible for broken windshields"? Well its kinda like that. Everyone with half a brain knows that if a rock or whatever comes off the back of that truck and cracks your windshield then they are held (by law) responsible. They just put that on there to save a few bucks on those dumbasses out there that know no better. It is legal to print anything, however, it is not legal to try and INFORCE a privately or corporately generated mandate that explicitly goes against written federal laws and guidelines (see Boostisgood's link above). This is true, even in the case of a signed and sealed consensual contract between two or more parties. But the warranty clause was not part of any agreement that u signed on a contractual bases, therefore making it all the more just a bunch of hot air that holds no REAL legal weight... And yes, I did study this... So I am not just talking out of the side of my ass here...

When my service manager first saw my turbo time he thought it was cool. I come back a couple weeks later and he says that he talked to a tech about it and said it could 'mess' with the ecu and send 'false signals' or some idiotic crap like that. I tried to explain to him that it only tapped into a couple lines and doesn't interface w/ the ecu and that its good for the turbo, etc etc..but he still said it might cause problems in the future. I love how they do the pre-emptive strike. They all thought it was cool at first, but then the service dept. is like "uh oh, a mod, we better say something..."

Thats bulls***..how'd they come up w/ that one?

I thought you found a different dealer that was better and had the sub replaced...or did they deny it too?

Oliver, I did tell them about the scratch before I drove it off the lot, and they did not say they would replace it for free, they said that I could either buy a new one or take some money off the price of the car. I dont know what that is about, I would have figured that a NEW car wouldnt have any damage to it at all, but they also informed me of a little dent in the door right above the window that cannot be fixed supposedly (they said they had some dent guys come out to fix it). Then somehow the Mazda centercaps on the wheels came off my car and those cost 50 bucks, so yet again anything with the rims doesnt seem to be covered for me by the warranty.

Matt

Phone mazda.....have your documents handy

Would it even matter anymore since this all happened before I bought the car and then I bought it? I am taking it back in to have a little bit of work done on the car maybe I can talk to them about it all again once I am there. Thanks.

Matt
