It is not advertised as coming with hardware or a gasket because the stock parts can be reused if they are in serviceable condition. I actually recommend reusing the stock hardware, especially the upper two nuts because the stock nuts have a much smaller outer diameter than anything from the aftermarket and they will go on (without grinding), while just about no others will. Some customers have had to or wanted to upgrade the hardware and have chosen to use a number of different solutions ranging from grinding on the casting to using spacers and socket cap screws - as shown on the site. Spacers and socket cap screws are cheap and can be bought from any hardware retailer. i.e. Fastenal, McMaster-Carr, Grainger, some Tractor Supply locations, most Do It Best Hardware stores, and many others. (Lowes and Home Depot are not hardwares stores and probably won't have what you want or if they do they will charge an arm and a leg.)
I've sold close to 50 of these now and have never had one contact the oil return fitting. The castings are all exactly the same (to within .001") so that means there is something else working against you in this department. I'm happy to help you diagnose the problem, its most likely simple, but voicing frustration on a forum without ever contacting the source doesn't solve problems. Its a very tight install with no clearance. Thats why you can't buy a Chinese DP on ebay for $89. Few companies have even tried a true 3" dp for our car and to my knowledge only MAM actually pulled it off, but it was such a headache that they only made 2-3 of them. Ion, GHL, and CS made some very nice parts, but had to make compromises in flow to get them to work. I tried to not compromise on flow and as a result some compromises have to be made elsewhere, like cutting the tab off the AC compressor mount, tight tolerances to the lower rad hose, and an install that can be pretty frustrating. Shoot me an email and I'll be happy to help you out. You will be a happy customer once its all said and done.
Here's a pm I got the other day - I think it says it all.
