Hatch won't unlock

2010 m3, i touring, hatch

am having issues with hatch lock. it will not unlock unless the car is turned off. can anyone help me determine cause and whether i need to look at programming or replacing the pushbutton switch on hatch?
 
My 01 Corvette wouldn't allow the driver to pop the hatch while the car was running unless the emergency brake was applied. When the car's engine was turned off, the hatch switch was operational. Try pulling the emergency brake to see if that works.
 
I assume you've tried using the unlock switch inside the car and not just the key fob? I have a 2015 sedan, but I know I can't pop my trunk using the key fob while the car is on. I have to push the button inside the car or shut the car off - I imagine the hatch works in a similar fashion.

I have a 2014 s GT hatchback and I don't think there is an unlock switch for the hatch inside the car.
 
What I have noticed with mine is when the engine is running the buttons on the remote do not do anything, just use the unlock button on the inside of your drivers door and that should unlock the hatch to that the button on the hatch will work to open the hatch.
