Same thing happened to my friend crossing the street on his bike years ago. I was right behind him, and we had just stopped at the store so he was eating one of those packaged apple pie pastries. I'm sorry, if you don't have a pair of sunglasses in your car, you are a road hazard. They should be required. Cops should give out tickets to people heading westbound in the evening w/o sunglasses. (or eastbound in the morning, like taking the Mass Pike into Boston)

My damage is a fender, wheel and paint and it came out to $1350.
I had a simular accident in a company truck about 10 years back. Coming down a street and an idiot armour truck pulls out of a bank trying to make a left. He realizes that he can't get into the lane he wants and stops dead in my path. Here I am with about two thousand pounds of cargo and I have to slam the brakes. I DID. By only inches. Didn't hit the armour truck... I look into my rear view to see a guy coming up fast and doesn't realize I'm stopped. He hits me at 40 miles an hour... I'm fine... The guy that rear ends me is fine... NOW, would you say the armore truck is a fault? Think about it

Yes the guy in the armored truck is at fault to you and me,
but the insurance company will blame the driver that hit you, because he should have been paying attention to realize that you stopped, and he was probably driving over the speed limit @40mph. (I'm guessing the bank was in a commercial zone, so the limit was probably 35, maybe even 30)

posted speed limit there was 45. I had so many people run over and say, "I got the license plate of the armore truck and the <i>How am I Driving 800 number</i>"... I called that number and talked much s*** about the driver of that truck. You're are right. The armore truck was not at fault.

there will be no court...theres no need, the police came, gave her a ticket for failure to yield to right of way and wrote up a report. she kinda looked mad about he ticket and said "but i yielded" and bluntly the cop said something like "you have to stay stopped, just because you slowed down doesnt me you can pull out in front of him...it was sorta funny, tho, when i was skidding and had no control of whether i was gonna hit her or not (which i knew i was) i was like yelling "NO, YOU STUPID **** ****** b**** STUPID ASS MOTHERFUCKER DAMN YOU b**** ****** b**** YOU b**** YOu STUPID b**** STUPID STUPID b****!" and i said this all in about the second and a half i was skidding. i also kicked the top grill and ****** it up and tookt he emblem off so i can do my painting idea.

no suv, 1996 ford escort, and linux, close, but im in webmastering, i NEVER do the work in here, i just sit and about 15 minutes till the end i yell OOPS! and the teacher (shes really weird cand campy and naive) comes over and i tell her i accidentally closed without saving...never fails
