A CAI will never cause you to fail Smog. The test pipe or cat delete will, this is why I went with a test pipe as I can replace it when the time comes.
Also, it is possible to fail the visual part of the smog test in California with a non-sanctioned CAI. Sometimes the techs care and other times they seem not to.
