ECU Flash After 36K miles

Good Day
Have 42k Miles on my 08 MS3, started it up after a short stop at the store and saw a the little engine light. Called and made appointment for this morning, I have gotten to know the Techs and I am a former SnapOn Tec Rep so the service mgr didn't mind if I went back and chated with the tech while he was checking the coed. He said it was a ERG Flow cel and they had a flash for it, I asked him if it was still covered under the 60K power train warranty and he said he didn't think so! I asked how much and he didn't know but we continued to shoot the breez while he took the 5 min it took to flash. I went up front to service manager and ask what it would cost to flash the ECU for this cel and he said he needed to charge 1 hr @ $105 but he could give me a break for $75. I asked him if he was crazy in a jokeing way and he laughed a little. The Tech came up with the paper work and had written N/C for diagnosis and winked at me and went back to work. The service mgr ask if I wanted it done, he said it wouldn't create a driveability issue but the coed would continue to return sporadically. I said I couldn't afford $75 right then and he said he would check with Mazda to see what he could do.
The service mgr said they where constantly getting new updates to fix origonal programing problems, I asked why they hadn't done it for me for free when I had taken my car in and spent $350 for the 30K service and he said they didn't flash ECU's until coeds showed up

Is this the same kinda thing any of you all have experianced as far as getting charged for 1 Hr for a update to a problem Mazda had created? How do you know how many and when flash's are available?

I of course consider myself very lucky today and went back and said thank you to the tech and gave him a $10 and told him lunch was on me!

I would think that stuff like this falls under your warranty as you seem to be within the year and mileage.
 
The powertrain warranty may only cover mechanical failures, not issues resolved with software. Haven't bothered to read the details myself.
 
it would be nice if you could get any more details on what exactly the flash did/changed. Mazda continually comes out with new flashes for all their cars and gives out as little info as possible about the changes that occur. hence why the accessport OTS flashes don't exactly work 100% on all cars...
