New emissions test with different EGR?

I live in Quebec and recently heard of them passing a new emissions law. Yes we didn't have any before. It will be starting in 2013 sticking a little probe in your tail pipe every year or so. My EGR, like most Protgs, eff'ed up a few years ago and I got the modified one that runs coolant through a part of it to prevent it from rusting (I think). Since then, engine isn't as smooth, but MPG has improved, weirdly. Have any of you done emissions test with the new EGR. EGR does control emissions, right??
