Here is what I was going off of.

"Reasonable number of attempts to conform motor vehicle to express warranty; presumption


A. It is presumed that a reasonable number of attempts have been undertaken to conform a motor vehicle to the applicable express warranties if either:

1. The same nonconformity has been subject to repair four or more times by the manufacturer or its agents or authorized dealers during the shorter of the express warranty term or the period of two years or twenty-four thousand miles following the date of original delivery of the motor vehicle to the consumer, whichever is earlier, but the nonconformity continues to exist.

2. The motor vehicle is out of service by reason of repair for a cumulative total of thirty or more calendar days during the shorter of the express warranty term or the two year period or twenty-four thousand miles, whichever is earlier.

B. The term of an express warranty, the two year period and the thirty day period are extended by any period of time during which repair services are not available to the consumer because of any war, invasion, strike, fire, flood or other natural disaster. "

It doesn't sound like waiting on parts will affect the outcome at all.

Can anybody else chime in about this? His goal is not to take Mazda to court, he just wants his car back in a timely manner. It sucks that he is making payments on a car he cannot even drive.

Subaru is a perfect example of this. Now people with legitimate concerns (usually regarding the drivetrain) are having a hard time getting warranty work done on their stock cars. Abuse is usually cited as the reason for denial.

Anyone browsing their warranty denial section and the horror stories posted would conclude Subaru is just a bunch of weasels. But looking at it from the other end, it's not hard to see why it has gotten the way it has. No one wants to take responsibility for their actions.

I have personal experience with the subaru, 2006 wrx impreza. With only 6000 miles. even before I took it the road hpde events. I was having issues with the tranny, it was the worst tranny i have driven. It would be hard to get it in gear, and sometimes pop out becuase i though it was all the way in gear. Im an experienced manual driver, i dont shift hard, because there is no point in slamming it in gear even when driving hard. I let it go it gear when its going to go in gear nice and smooth. But It was still the worst tranny car i have driven. so i sold the car. I couldnt take it anymore. other than that the car was pretty good for the 6000 miles that i had it. the brakes def suck though, not big enough for the car. i agree that most of the blown trannies are people trying to launch their cars prob, which puts to much stress on the tranny for an awd car somethings going to break eventually.


Id rather stick with honda/acura, and well see about mazda if this ms3 holds up. so far the cars been good. shifting is better than subaru but worst than honda's, in between.

Keep climbing up the Mazda of NA corporate ladder until you get to someone who's responsibility doesn't involve talking to customers. Just need to get involved with people who either don't want to deal with it or someone who has an ability to do something about the dealership in question. There's no reason to be jerked around more than the initial one, or even two times max.
