You can't win against the state of Virginia, believe me I've tried, and always get a letter stating that they are gonna sieze my vehicle or suspend my license. Tell him to get a lawyer and he'll get it dropped down a bit, believe me they've got DUI & DWI cases with hit and runs that they'd rather get to then speeding tickets, unless he ran from the cops or something.

I got a 400+ ticket for doing 98 in a 65. I depends per county I believe. I also heard that in Texas you can get your license revoked for going 30 over the limit...

Tell him to find a good lawyer and better be glad that he didnt kill anyone or anything at that speed. They will NOT be leaniant on him when he goes to court. Va has some strict traffic laws and they dont play around up there. I've gotten pulled over just for going about 70 in a 65 if that tells you anything.

I was ticketed for reckless last year, 77 in a 55...if you didn't know, in Virginia, they can give you reckless driving for going 20 over the speed limit, which is a mandatory court appearance. If they throw the book at you, it's up to a year in jail and big-ass fine, so you bet I lawyered up. (Also, this was in Fairfax County, where the only person who can talk to the prosecutor to try to get a plea bargain is your lawyer.)

When I was doing my research, I found this site that gives a pretty good overview of reckless & dui laws here (though I didn't use that firm): http://www.vatrafficlaw.com/reckless.html. It talks a little about radar and lidar and going after calibration.

Your friend's best bet would be to do his research & then if he's going to fight it in court, find a good traffic lawyer who's familiar with the court and judges in whatever county it happened in.

Law states you have the right to continue once.Human error now comes into play....higher chance of paper work being shuffled incorrectly. I showed up on the second date.....officer had no record....judge dropped entire case....no court costs, no points, NADA. Give it a try, doesn't hurt. Oh yea... no lawyer.

There is some validity to gettin a continuance...but why prolong the inevitable. Besides, continuances can be frowned upon. Particularly if the Judge feels you are just trying to drag things out without reason. It's not like this is a murder case where all the evidence hasn't been taken into account. It's a moving violation.

Going to court without a lawyer is never a good idea...they always find some way of f'g you. You have to have someone on your side that knows the system. You can't count on the "cops not showing up" scenario or the the judge will hear your story and be compassionate. Stop chasing unicorns! If you are to the point you are scared you will get your ass handed to you enough to post your drama on this forum, lawyer up. You have a better chance of getting off or getting a reduced sentence with a lawyer.

must have went through a school zone doing 100+ mph. then the crossing gaurd got in her station wagon and walked him down to hand him the $600.00 ticket. pay the fine and move on, take it to court and you'll probarably pay more, court cost, fine, community service. or next time just don't pull over. if he clocked you speeding, you already gonna get a ticket so take a chance and run..........just kidding..if you play..you pay...good luck

95 in a 65 is wreckless or at least it should have been. In the state of Va anything over 80 in a 65 you can be charged with wreckless driving. The thing about wreckless with out of state drivers is that the cop doesnt have to let you go. He can lock you up till the court date or if you make bail. Even if you are in state, any ticket that you receive the arresting officer can take you to jail. That's why the cop tells you that all the ticket is a summines saying that you will either pre-pay the ticket or go to court. In the state of Va if you receive a wreckless driving ticket you have to go to court. A wreckless ticket is not pre-payable in the state of Va. If you fall to go to court a bench warrent can be issued for his arrest. Also in the state of Va wreckless driving in any form carries up to 30 days in jail. Most of the time the judge will suspensed the time in jail unless your driving record is very very bad or there are other factors invovled in the case against you, i.e. you were racing or you failed to stop or you multible infactions at the time of the stop. Your friend really needs to find out if he was giving a wreckless driving ticket! Because if he did he will need to go back to the county in which he received the ticket on the court date on the ticket. Its very hard for me to believe that he did 95 in a 65 without getting a wreckless driving ticket and with that big of a fine. If you are wondering how I know what I know its because I have been to court many many times. Now I have two future brother-inlaws that are local cops and I have picked their brains for as much info as I can get on the subject of traffic infractions. I have even been to driving school once were a cop asked me if I was a lawyer or something because I knew so much about the laws in Va and the rights of drivers in Va. I responsed with, "No, sir. I have just been thro the courts enough and know alot of cops now." I have a co-work that last month got pulled over for 83 in a 55. He received a wreckless driving ticket and asked me what he should do. I called one of the cops I know and he told me that there are two judges in the area he got stopped in that will give up to 5 days in jail for anything over 80mphs. The cops only advise was to not show up to court without a lawyer!
