They probably won't get him on the drunk driving charge...if they had the evidence they would have arrested somebody in the house that night. I suppose he could claim to have been sober until the accident and then he ran in the house and started pounding beers back.
Were there plenty of witnesses who saw someone run from the car to the house or were people just making the assumption it was him because they recognized the car? If people saw him stumble and fall down as he walked back to the house that could help prove he was drunk.

My last two accidents have been with people who had State Farm, they always pay quickly and they dont hassle you.
