Rearended on my way to school

so yeah, i was rear ended on my way to school 2day
the other kid was coming off of a off ramp onto the road and i was further up the road. a tractor trailer merged in front of me so u slowed down and the other driver hit the passanger side rear corner of my car

he claims that he didnt see me slow down...how do you not see my blazing yellow? (bang)

he was driving a 99 benz and had no damage
my bumper is scuffed up and sratched

we didnt decided not to call the cops and he said not to go to my insurance

if he decides not to pay and i go to my insurance will not having a police accident report and no witness that stopped hurt me?

yes. i always call the cops if there is damage.

You should always get a report and tell him it is so that both of you have protection.




I'd hate to say it but you could get shafted pretty easily at this point.

i was on william penn and he was getting off of 33

there wasnt much damage i could prolly buff the scuffs out myself
...im calling him today right afer school to see if we and our parent can meet up tonite and see what we're going to do

its clearly his fault for rear ending me
he said he didnt see me..maybe if we would have called the cops
he would have gotton cited...careless driving maybe?

i should have followed my instincts and called the cops

Good luck; unless you're his bestest friend in the whole wide world, you're out of luck.

It's his word against yours that the accident even so much happened (parents included or not).

File a report, you cannot make a claim without one. Here in Calgary we can file a report within 72 hours.

Yea man just like everyone else said. Nothing short of you being in the mafia and having your cousin vinny dangle him by his feet of the edge of a building will get you your money. Always call the cops man.

+1 Get as much info about the Benz as you can too (VIN, plate number, etc)

I know in my state, you automatically get cited for rear-ending someone, no matter what the excuse is. Definitely get a police report, take his info with you.

I had someone back into my car on the school parking lot. We did not call police because she said she would just file it through her insurance.

Never heard from her again. She avoided me like the plauge from that day on at school as well.

Moral of story, ALWAYS CALL THE POLICE!!! Without police report, i was F'd and had to pay out of pocket to fix the car

That sux man. I would def. contact the cops and see what can be done. I just hope he gave you the correct info or you were able to get his plate # yourself.

not sure how it works for you, but around here if there is nobody injured the police don't even file a report. so it wouldn't have mattered if you called them or not. non-injury accidents with cars that are still movable they suggest you just move the cars out of the way (if they are in the middle of the road), swap insurance info and handle it on your own.

now you should have at least taken his insurance info.. just in case: then you could always call his insurance if you don't hear from him soon.

..maybe i should have..at least the cops would have been there then

i was so nervous tho too...first accident ever
