Ok,

Well, this is my first post in 2 months, as I have been going back and forth with Mazda and the dealership over my transmision problems, and everything has been passed on to me now.

Has anyone (prefferably in Ontario/Canada) experienced sueing Mazda.

I had a broken lockout when I bought the car, got it replaced after 2 months, after some back and forth with the first dealership.

Second dealership fixed it. It broke 5 months later. Mazda said it's not a manufacturers defect, so we paid to get it fixed, as I need a car.

I get the car back, and I can still go from 5th to reverse, and the lockput is there, it just slips by it at times. I showed this to the dealership, and the saw it, but want to take the car themselves. They refuse to warrant the work I paid for.

I know I have mazda on this, as there is a problem even after they fixed it. I am just looking for some idea's on what you had done.

There is arbitration here in Ontario too, I am going to try to get Mazda to buy the car back, I have just had enough.

Had a broken crank on my 90 Miata (a know problem that was fixed by a new crank design mid-91)
Regret had no luck with Mazda - bit the bullet and had repair myself (at an independent)

Sorry - do not mean to seem stupid but what is this lockout? I have a 5spd P5.
 
It's a mechanism to prevent you going from 5th to reverse..

Did you use arbitration, or courts?

Werer you under warranty?

Thanks for the explanation - that's what I assumed it was.

Have to tell you, I have been driving a standard for near 40 years and have never tried to shift from 5th to reverse.

Can't tell you if my 5 'lockout' works or not
 
Pit it in 5th, then go straight down, does it go to reverse, yes, there is a problem, no, then it's working..
 
Again I ask - why would you want to go from 5th to reverse?

Anyway - with my Miata's problem many owners had already tried for a fix with no luck. I contacted Mazda Canada myself and that was a waste of time.
The car was not under warranty - however it was a know defect of the crank shaft nose in '90 and early '91 Miatas.
 
It's not like I am intentionally doing this, but sometimes it would slip, like slipping into another gear, it just gets sucked in.
 
I think you should ask your lawyer instead. Or maybe you should write a letter to Mazda or something
 
It's not that you want to go from 5th to reverse, but for me, when I got to put it in 4th, sometimes it goes right into reverse. I don't think I have a lockout either. With the car off, I just went outside and could go from 5th to reverse like a 1-2 or a 3-4 shift.
 
Yes I checked and I can not go from 5th to reverse - have to go around a stop or as you call lockout.
no lemon law in Canada
1) I would ask dealer to fix again in "writing"
2) If no satisfaction them ask to have a meeting with the dealers "area Mazda rep"
3) If no sucess - check your manual - there should be a procedure to follow next

You must "document everything" - ever time you called,went to the dealer - who you talked to.........everything - date,time,names......

I have no lockout. Dealer said it was normal. I know they are wrong. I dont want to be bothered. I am just more careful. It sucks but I pick and choose my battles
 
Well, here is an update..

I haven't been on as I was just upset at anything to do with this car..

After paying $2200 for repairs, and $560 for rental, I got the car back, with the intention of suing, or going to arbitration for the car (arbitration in Canada is www.camvap.ca). I had the car for 1 week, and I was able to slip into reverse, bypassing the lockout. The dealer that repaired the work refused to fix it. I demonstrated the problem to them. So I chose arbitration (faster, no need for lawyers, just represent yourself.) After a little while, and sending in my side to the arbitors, I got my date. I saw Mazda's side, which stated that I had abused the car. At the hearing, we even made an offer, just give us the money back, cause I would just dump the car, but they refused. Mazda also said that the reason I was slipping into reverse so easily is because I had worn out the lockout (this is hardend steel here!!!). 2 weeks later I got a call from arbitration, wanting to take the car to a mechanic, and have them inspect the car. I showed them the problem, and the mechanic and adjuster drove the car. They were able to replicate the problem with out any issue, even @ 100 km/h (painful to hear grinding, but needed..). They also looked at the old broken parts, Mazda had replaced the identical parts from the first time, and the same results happened, lockout breakage,and that Mazda's claim of wear on the lockout was false. So I then got a letter this week, from the adjuster stating a few things I said above (reproduce and no wear) . He recommended that the Tranny be replaced or dismanteled and inspected. There was one other thing, the spring when you go towards 5th, is like much, just as easy to go in the direction of 1-2 a it is to go to 5-R, that was something I didn't really notice. He, like the service manager a long time ago said, the Tranny should be replaced.

I hope it does, well, I got a 2 week wait left.

Then I may be able to enjoy the car again..
