No Matter What You Do- You Can't Keep The Car Perfect For Long.....!!!!!

2012 Cadillac CTS-V Coupe // 6spd
Welp 3 months in- no car door dings, no chips, no scratches, nothing.....Till today that is! Me and my girlfriend called a deli to order our sandwhiches in advance so that way when we got there I could send her in real quick to pick up our order. So when we arrived as she went into the store some pimple-face kid comes out staring at my car. He walks around my car and gets into his brand-new Acura RSX-S. He starts the car and practically peels out of his spot in reverse not even cutting the wheel at all. I look over and see the back of his car traveling the 25 feet between me and his parking spot. I promptly lay on the horn- he continues his thrust backwards and SLAMS into my rear quarter panel! With enough force to shake the entire car!! I explosively get out of the car and rush around to check the damage- to see my rear quarter panel pushed in, scratched, and damage done to the rim as well. I promptly get on the phone to call the police to get an accident report- pimple-face calls his mommy and daddy.
When the cop gets there he says it's both our faults. 1.Because I was in a fire zone, and 2. Because he hit me. I talked to the officer to assure that the actuall accident itself wasn't my fault as I wasn't even moving. The way he made it sound was that it wasn't my fault and he only gave me the parking ticket because he had to in this case. The kid got a moving violation because he was the one that hit me. I'm just worried that I'll run into problems with his insurance company trying to collect the money for damages- ya know, expecting them to try and hang on the the "you shouldn't have been parked in the fire zone" thread!
Anyway as we were finishing up the punk kid's whole family was there- Mommy, Daddy, and sister. His dad was walking around fuming and ranting, "he shouldn't have been in the fire-lane"...yatta yatta. I overheard the cop saying to the kid, "You couldn't have been looking both ways when you backed up- look at it....it's such a bright color......." lol *Gotta love Laser Blue*
Oh well my car has joined the ranks of accident scared. I guess it was only a matter of time. No matter what I do to aviod damage- it seems to come to me no matter what. And in this case- in the form of a rich-babbied pimple faced RSX ricer. UGH!
Here's a pick of my poor baby! *one hell of a spot to get hit in too, huh?! Don't know how, exactly they are going to fix it?!!*

honda drivers dont know how to use the rearview as they are always looking ahead when they are getting their asses handed to them, thats the whole problem. LOL

omg man....

i'm tyring to keep mine gem mint and this sorta stuff is just scaring the heck outta me. Maybe i should just leave it in the garage forever, lol

damn pimply face kid. hope you get no stress from hsi insurance
 
That sucks. What a tool, he LOOKED at your car, KNEW it was there, and managed to forget and back up into it. They'll probably replace that one body panel and paint it. Could be worse.
 
The thing is the panel seems to go on forever, lol. It starts at the bottom of the rear door, encompasses the whole fender and is connected to the roofilne without and seems! I'm worried that they'll need access to it from inside the trunk. I have the whole custom audio in there, false floor, neons etc. Everything is bolted to the car. I'd have to take it back to tweeter to have the whole audio system broken down to gain access to the rear quarter panels thru the trunk! UGH what a nightmare.
About the insurance- I can almost guarantee I'll have problems with the kid's, or should I say the kid's MOM'S insurance company! I'm ready to go to war over this.
The friekin jerk-off had the nerve to say he didn't see it! First off he was eyeing it up as he walked by it and when he backed up it was litterally directly behind him. Not to mention I have a bright day-glo laser blue color. What a freikin tool!

What will happen is you gotta turn it into your insurance co, the pay for the fix, then recoup the money from his insurance co.

Ohhh and I see you live in jersey, you know anyone with a "waste managment" company there ? cause an RSX-S in the hands of a pissy little, pimply face, no respect having, b**** ass, mommas boy, is a waste :D
 
LOL. Boostisgood, I'm just worried about dealing with my insurance company at all in fear of my premium going up. Any sort of claim they have to pay will cause it to sky-rocket, and I'm already paying an incredibly high rate (which NJ is infamous for, even though I'm 25!). I dunno though maybe if what your saying is correct it wont work that way. I hope not- I want to get this fixed asap, and withouth any money out of pocket. If I have to either 1.Pay my $500 deductable or 2. Have my rates go up- I think it's completly unfair....especially beings I wasn't even moving when I was hit! Oh well keeping my fingers crossed.
Darn why couldn't he have totalled me- then I could sell out and pick up a new SRT-4......lol!
 
I wouldn't be surprised if you wind up having to get your insurance involved, as the way to cop wrote the ticket, you WERE partially at fault, and likely the other insurance company is going to want to share the cost - In your particular case, it might come out less expensive (in the long run) if you just fixed it yourself.

I can't tell you the number of times I've muttered (under my breath) about there being no cop around when you need one every time I see somebody parked in a fire lane just outside the entrance to a store - It almost automatically creates a traffic hazard, to say the least.

It's sad that you got run into, (and I agree that the kid was mostly at fault) but YOU could have prevented this one . . . . .

Thats the same mentality as "I would have never gotten in an accident if I didn't drive today"....or "only if I had taken the back road home". You can always say I, you, or him could have avoided an accident- sure hindsite is 20/20.....but by no means does having my car parked in a fire lane the "REASON" for the accident. The "REASON" is the guy backing into me without looking. Heck, if it were a pedestrian stepping off the sidewalk at that moment he would have rammed him, the kid wasn't even looking behind him.
Also, sitting in your car as your gf runs in to pick up an order is far from a "traffic hazard"- maybe a nussance to the fire dept if it were unmanned and turned off. I'm sorry, but I disagree with you here- the only "traffic hazard" was the smacked ass who reversed out of his spot, full throttle, 25 feet, without cutting the wheel and without looking behind him.
 
Look for a loophole on the fire lane thing. If the driver is still behind the wheel I don't think that the car is "parked". Isn't that called "standing"? There are always objects in the fire lane anyways like shopping carts and pedestrians. Chances are good that someone/something would have been in that spot if your car wasn't there. Just remember that it's the insurance adjuster's / claim representative's job to screw you on the repair so don't take any guff from them.

You are right hindsite is 20/20.
I am with you and hope you get payed 100% but I agree with Don in that in reality if would split, lets say 85% his fault and 15% and you would get paid 85% of the damage. This is how a court would decide a lawsuit. The kid was at fault and I hope there is a way to "repay" him :)

SORRY BRO!!!...As a mixed martial artist myself(grappling, joint locks), I say.....just take it to the mat..and the hell with the insurance companies...winner replaces all....LOL!!!...Anyway, I'm truely sorry, the harder you try to take car of things, the more likely something "WILL" happen. ..I hope all works out..Peace!...BTW, I love your avatar....which event is that...looks like from extreme fighting and not the UFC...just curious.!

I feel your pain, Lazer.

I bought my P5 almost three months ago, and I've been babying it. I park in the back of the parking lot to avoid dings (of course, some a-hole always parks next to me in an Excursion or something anyway). I park carefully so if I have a passenger, they don't swing the door open and bang something (amazing how many people do this).

So, my car got marred, and it ended up being by ME. :mad:

I went to try to get the retarded dealership decal off the back. Several people advised using a credit card to get it off in conjunction with WD-40.

I got it off. Only problem is, now the whole area is covered with micro-scratches from the credit card. :eek:

Guess I'll try some touch-up paint, or I'll be back at the dealer with it.
 
Don't forget about the age factor...if they try to place any blame on you, bring up the fact that it was a kid who hit you and he probably hasn't had his licence very long. How old was he btw?

If he brought the who family to the accident I'm thinking it wasn't even his car...it was prolly his daddy's baby. If so, find out if who is the primary driver of that car and use that as well...he might be insured on a beat up ford escort and he was taking his daddy's toy for a spin....

Also, if you can prove that there is no way he looked before moving...post the scenerio of a pedestrian or worse...a FIRE TRUCK, parked in the fire lane. Laser blue stands out just as well as fire engine red IMO!

And don't forget to mention that he walked by your car and you saw him look at it...

So you have two options, he didn't look because he's a young driver, or he knew you were there and didn't care. The latter being more believable in court.

I don't wont to get off of the thread here as it it truely a horrible thing.........although I respect everykind of martial art self defense methods and hybrids. Your descipline intrigues me because of the techniques used...which I question, unless you tell me otherwise, your approach is to use your opponents energy and momentum to your advantage...the problem I have is, what if you opponent attacks your legs and it ends up on the ground...there is no momentum. I know you do use joints locks,..so I can see "some" effectiveness there, What would you do?? Also, it is always shown with the aggressor being out of control when attacking, which I can see your method being effective, but just wondering on a controlled attack with a different style. From all Mixed Material Arts form competition events I've seen or been a part of, I've never seen your discipline being displayed. I do realize all forms have pros and cons...just curious to learn more. So again no disrepect, just curious??..Peace!

Haha, I would seriously hate to end up on the ground to tell you the truth.. I have always wanted to do a less traditional style of martial arts that focused more on the most effective methods of grappling (such as Brazilian Juitsu, Sambo). I started out with more traditional styles, but I would like to "continue" with more effective methods for every situation. I want to be a more "rounded" practitioner. It's all good!:cool:

Hopefully it wasnt his car, I dislike parents who buy their kids "fast" cars. Yet never truely teach or check to see if the kid is "mature" enough for it.

Once saw a kid in a brand spanky new Supra Turbo (MKIV). He got ohhh about 7 miles from the dealership before wrapping around a light pole. Completely totaled the car trying to take a left turn at about 60-70.

Was at a Ford dealership while back looking at trucks for my dad. The salesperson there was busy talking to a family who was trying to buy a SVT Mustang for thier 16yr old. The salesperson finally got them to agree that it was to much car for someone inexperiance and young.
