MY 2008 mazdaspeed3 's shift lever came off after 1 year of driving. no warranty

This are the picture of the broken parts.
I believe it does have some serious issue on design which make it so fragile.

And the stupid paper work.

"Lack of Maintenance/damage/alterations/modifications"

My all 4 tires. The left rear tire has melt. I did told them i bought them like that when the day i left my car there.

For a FWD car, it's not possible to have 2 front tires brand new but back tire melt. I did tell the people in the dealership I bought the tires like this on the day I left my car there and Im very sure that they did not mention it to their "Mazda representative" at all. And they must have discussed with each other how to find some S**t off this car to have the problem not be covered under the warranty, even though they probably already knew this is not the first case on the same car.

I not only bought the car from this dealership, but also all the maintenance including oil change every 3000 miles on time and what ever they told me is coming up on 6000 and 9000miles.

Too bad this is my last visit to this dealership, and i have to make sure all my friends will do the same.

So which city , state is this B.S. dealership in, so we all don't go there?

Alhambra mazda in California. A previous reply which had the same issue happened he was in san jose. Same state but got it fix under the warranty with no difficulties. I can't understand this

I think were missing a part of the story.

What do you think is missing? Thats all what happened. the recent 2 weeks the shifting got weird, Last friday i brought my car to the dealer ship, all they said was they will ask mazda representative about the warranty, wednesday got phone call they denied it. Finally today i got it back and paid for.

I Thought it won't happen only on my car! They really should have recall all the vehicles that might have the similar problem.
I CANT BELIEVE THAT THEY VE BEEN SO IRRESPONSIBLE!

for the record. it takes ALOT more cases then just two to have a recall done. consider pretty much every escalade on the road probably has a replaced fual pump. lol. if anything, it might become a bullitin. but even that take's alot more calls then just two.

honestly i am surprised it only cost you $470.00 not that that is a small chunk of change, but for stealership work i was expecting it to be like 1500 or more. when i had my truck it went through 4 transmissions in 7 years and 100,000 miles. every transmission came with a warranty and failed within that warranty. every single time the warranty was denied for some BS reason at different ford dealers. a new 4r70w transmission for a ford f150 is $2500 + labor from the stealership. i will never buy a ford again, (unless i ever have enough money for a gt someday)...
that is total BS that they denied you bc of different tires. i would write a review of your story and send it in to the local newspaper as an editorial or something and get your story out to as many local people as you can. if you reach enough people it is possible to bring down the dealership.
that totally blows though and i would NEVER buy a mazda again.

well thats two dealers that we shouldn't go to now. Alhambra is probably the closest to me, but mines is at Monrovia and got "DENIED"...... for now.

another option for you would be small claims court.

Im pretty sure its not gonna be only 2 cases. This gentle man just read my thread and respond in a few hours after my posting. If I didn't have this problem i would never even come into this forum. Im sure there are lots of more MS3 owners don't look into forum but had the same issue.

this really annoys me that they wrote it off and made you pay for it. i would fight this to the end. i could understand if you had some mod that actually affected the shifter but new tires? that's like saying that by adding my air freshener it affected the air flow of my car and my exhaust is not covered for warranty work.

there was another member that went into a dealer, cant remember if it was Browning or Riverside but he was nearly fully bolted and broke his shifter. They replaced it under warranty no questions asked. Riverside has a good report with the modding community and you might have better luck with them.

Wouldn't the "melt" tire (see pic #3) be able to be construed as "abuse"?

Quite possibly, yes. In a legal case, I would imagine they would make that point.

And I'm not countering that argument, just posting a thought- I know that what Mazdaspeed does as a subsidiary doesn't necessarily have to jive with what Mazda NAO's policies are, but since Mazdaspeed does support racing of all sorts, and encourages people to race their Mazdas (in legal venues, etc.), I might counter that abuse argument by asking why one of their corporate entities encourages such abuse. If I were, gawd forbid, ever in court arguing such a point.

I know the counter to that is that they have disclaimers, and you should wait until your warranty is up, etc., but it might make the judge/jury think twice before bringing the hammer down too swiftly in Mazda's favor if they are made to look like hypocrites for making excuses with fine print.

damn sry to hear about this..my shifter broke also miller mazda here in tx replace mine no questions asked...they also replace my turbo when it started smoking even tho i had full tbe, bov, and intake...gave me a rental free of charge for a few days and even gased the car up for me before i picked it up because they said they had to drive it to make sure it wasnt smokin anymore...miller mazda in waco tx is a pretty good dealer!!
