MY 2008 mazdaspeed3 's shift lever came off after 1 year of driving. no warranty

Just spoke to the customer assistance.
They said that both dealership and their representative "THINK" That the damage was cost by outside influence not the defective part or anything, the reason was the tire was "melt". And it was been reviewed by the highest mazda warranty department. I cannot believe how ridiculous they are. According to The replies of several members who had the same issue happened. It is quite obvious it's a known problem in their warranty coverage. I do not think that they only have fixed 2 cars for that problem.
Never buy a new mazda again ever!
I need to go to a small claim court.

What you think and what has been done are two different things and I think you're chasing a lost cause if you're trying to claim that this is a known issue.

If I were you, I would threaten with a lawyer and then if they call your bluff, do what others have said and talk to a lemon law lawyer. I can't believe they'd actually deny a claim for excessive tirewear...you could just have easily said that your tires skid when trying to avoid an animal or drunk driver at some point in the past. Claiming that it was intentional abuse and a shifter shouldn't be covered is completely subjective and its even more ridiculous when you consider the softness of the stock rubber. Did they explain how a tire could look like that?

Then again...a service rep at my dealership told me that the break-in period for our car is 3000 miles and that you're not supposed to drive it hard...she no longer works there and I can't imagine why.
