MY 2008 mazdaspeed3 's shift lever came off after 1 year of driving. no warranty

I bought an 08 mazdaspeed3 sport on april 2008.

Now it got 11600 miles on odometer with just a little more than 1 year of usage.

recent 2 weeks the shifting was getting weird. After I back up and tried to switch to the first gear it would just go to the reverse again (without pushing it down, it just went down by itself). A few days ago I couldn't get it shift to the reverse gear because something felt stock inside. I had to get it back up tho i finally pushed it down by using a lot of power.

Last friday during driving, the shift lever finally came off, the whole stick. I called road side assistance and they towed my car to the nearest mazda dealer. They took picture of the car and then finally called me back on the next Wednesday said that the mazda people came and checked the car. They made the final decision that it wont be covered under the warranty. Because It seems like was been modified. Then, I told him i never mod the car he said "The tire was changed" It's the first time I ever heard that tire change can be considered as a modification. And even if it was but what it has to do with the shift lever?

I went 2 track days. One on Nov. 2008 and last time was Feb, 2009. They weren't rough racing, just do some track laps. Therefore I had to change the tires and I bought 2 new ones and 2 used ones. Used ones put in the back and new ones put in the front. The used ones did a few track sections by the person who sold them to me. The people in dealer told me the tires seems been wore out badly. They just try to claim that i misused the car and cause that to happen. They told me I ran over curb too, they can tell from the bottom of the car but I dont think those are the factors for the shift lever to come off. The dealer people said its the decision mazda people made, they cant really do anything and I have to pay $500 to get it fixed.

Have anyone else ever had the similar issue on their MS3? Or just me? I m thinking of going to court if they dont give me better answer. I called mazda of america, the customer assistance just told that she will check into it and get back to me but havent heard from her yet. After this experience I really would not buy another new mazda vehicle ever.

Any suggestions?

that's BS. They cannot blame that on a tire. However, it does sound like you were rough with the shifter. I just can't imagine it breaking under normal use.

get the car back from the dealership and put in a twm or cobb sts instead. 250-350 instead of 500. You can pick one up used too im sure for a bit cheaper.
 
then leave the car there and get a shifter next day aired, still be cheaper then the dealer cost. Either way sounds like its gonna cost. something as small as 500 buckss isn't worth it in court, you will spend hella more on court costs and lawyer fees.
 
i've seen another post like this; guy was just driving to get food and shifted and BAM broke off in his hand. Mazda guy found speeding tickets in his glovebox and deamed that the car had been abused and said the warranty wouldn't cover it.
If this ever happend to me on any warranty issues i would blow my ******* top and toss a giant steaming hot pile of s*** storm all over that dealer ship. Fight for your rights man, bring a lawyer with you to the dealer watch then pee their pants and replace your shifter for free stupid *****.
 
Hearing sh!t like this makes me want to never buy another Mazda again. Honda never pulled this crap with my RSX and I had I/H/E and had some warranty work done to it with no problems. I guess Im going back to Honda.
 
That is just BS. Hearing stuff like this makes people very wary about buying a Mazda since even 0 mods can now have your warranty voided. Such bastards.
 
Wow, what a crock of crap. I'd have started laughing when they told me that, and if they didn't laugh with me, I'd have gotten pretty damned vocal when it became apparent they were attempting to be serious.

Unless there's more to the story than we're being told, you should accept nothing short of a full warranty repair.

I went into the dealership where I bought the car and told them what exactly happened. I had around 12k miles when it happened. They took care of it under warranty.

I Thought it won't happen only on my car! They really should have recall all the vehicles that might have the similar problem.
I CANT BELIEVE THAT THEY VE BEEN SO IRRESPONSIBLE!

have it towed back to your place of residence and get a TMW shifter and install it yourself. there is a "how to" posted with pics.
 
Hire your local Mafia and put a hit out on this so called "Mazda guy." That'll scare mazda and show them not to mess with us and our warranties by claiming stupid stuff like "he changed the tires."

I really would love to but they definitely cost more than $500. I d rather go to downtown and hire some "street fighters" go beat up the service dept guys.
 
The dealership called me an hour ago and told me the car was fixed. I went there and wanted to have a fight with them. The manager kept telling me that it was the mazda representative came in and made that decision. However he kept the old part for me to talk to mazda. But i still have to pay them in order to get my car back.
Although they can take the new part out. But its still too much hassle to tow the car and I have busy summer school schedule. I dont think I have time to work on it by myself, and I have no experience either.
I guess i just have to call mazda again after the holiday
 
this doesn't look good, it starting to become a trend now. Mazda seems to be denying warranty left and right now. Look up local lawyers that specializes in lemon law and talk to them to see if you have a case. That is what i'm doing with my situation.

tell them new tires are not a mod. They didn't make the bridgestones that came on the car anyways so wtf.
