May lose my MSP, Im PISSED!

Alright! These are answers I was hoping to find. I was about to give in and bring it back till reading todays posts.

Thanx for all the help and well wishes. This better work out. I actually went to my dad tonite to see if he could help. I need to be able to have something done by Wed they said w/ the hloiday coming up.

I am about at my wits end tho. Ive been stressin on this for almost a week now.
 
By the way, two great sources for not so happy car loans are household auto finance and capital one- I just refinanced my car through capital one(and trust me, I have bad credit) reduced my monthly outlay by 30 bucks and lowered my interest by 2 points to 14.9% hope that helps
 
id say if you can untie this whole transaction then do it.
take all the money back and your trade-in if you had one leave them the car yuou had for a while and leave

firsts off if thats your attitude they will try to work something out, trust me they still want to push it out the door .. however great u think it is

second you can say this is all bulls*** and say you have to consult your attorney .. let them wait another week .. more reason for them to get it resolved

third if u act on it and you can get back what you gave them and leave the car .. you're still ahead ... unless this is the only mazda dealership within 150 miles .. i bet you can find the same deal or better ... i have 6-8 dealers near me so if their boring me with their stories i just get up leave without saying nothing .. if they ask why i say give me serious offer cause im on alimited schedule here

now my opinion on the sale contract /and im no lawyer/ is that the price is binding .. the loan paper you got was only a prefilled application for some bank/lender .. the dealer has nothing to do with that nor they approve you credit /except for commission maybe/ .. they only set the price with you and based on a pre-approval formula refer you to a lender that they feel will lend you money

that said i would think its your responsibility to secure credit wethear with this lender /possibly higher %/ or another on their terms

as to taking the car back ... im not sure .. id drive hard for few more days and give back but only if they refund all of your inputs and there is no negotiations here - it has to be full refund .. they
cant say you drove it for a month so we will keep 500 from your deposit

since they acted on the assumption that you qualify for credit, they are taking the risk in case you dont ..thus assume all associated costs

another thing to say is that you are not qualify to make those decisions and you dont know off all the outcomes/consequences/complications possible

its their credit guy's job to know that and make you aware .. if they make any allegations that this is your fault .. say you have to refer to an attorney who specializes in this area

at least thats my common sense view of things .. relation to facts is unknown
 
Good luck with your car. There is nothing, legally that they can do at this point of time. The dealer knows your score in less than a minute by typing your SS#. 3 weeks is a long period anyway. If this was true, you would see all the cars taken back by the dealers.

This is a scam to try to get more money out of you by raising your APR on the loan...Fuckers.
 
the dealer is the middle man between u and bank loaners.....u have no abligation to make sure ur credit is ok or anything, thats why they fill out the credit application, get ur "point" status then haggle with banks, its between the dealer and bank weather the credit is really aproved...the dealers are tryin to cover their ass , simply put......
 
OK I got the upperhand tonite. I have access to the cash to pay out the difference in the amout I need.

SOOOO now Im goin to the dealership and will have no qualms about raising the roof off the place and trying to get the absolute bottom dollar on this deal. Hey, they started this game and I intend to finish it.

My wife works at a law firm, the attorneys will be getting all the paper work in the AM to review and possibly call the dealer.

I went to the bank today and there for real IS an issue, its just how it will be resolved is the question. I want THEM to make it right for misrepresenting themselves by saying they are AUTHORIZED by my bank. Well come to find out they are authorized...to WRITE for them. They made it out they could get my approval.

Worst case scenario is I have to pay out the extra and I keep my car.

This wouldnt be a problem and Id take it back (w/ 1500 miles on it by the time I got down there told ya, we rack up some mileage fast) if it werent the LAST yellow one known to exist w/in any kind of a reasonable drive. I went almost 60 miles to get this one and it was the closest by about 100 more miles.

Now that I think about this, I cant believe I drove 60 miles to get a freakin car in the color I wanted! LMAO!

So in the long run, one way or the other I will be keeping my MSP after all. I am ditching the extended warrantee tho.
 
Oh yeah, I DO have approval for a loan. Now I see how much comes out of my pocket and how much comes outta theirs to make this work.
 
dont say u have the cash in difference....im tellin u the dealer is tryin to cover themselves for their stupidity.....put ur foot down with ur wifes lawyer firends help amd get what u want...
 
well .. hey sounds like its all gonna work out one way or another ... but

give them hell. say they waisted your time and caused a lot of trouble .. and if you have a chance you'll bash them in any possible ways .. ie surveys and stuff

then say you want year worth free oil changes or whatever else u'd like

hope itll be all for the better .. have fun with it and stay firm on what u want

yeh stay firm....it was their mistake and they need to fix it.....u shouldnt have to bent over and lift ur skirt for them........
 
Its like this, the internet can be a good thing or a bad thing. Screw surveys. MANY more people see the net than surveys. And people looking into an MSP will find this site to do research. Itd suck for them to see their name plastered all over in a negative way.

i was at a mitsubishi dealer and they wanted me to

ok im 18 thers no way i can get a loan for a evo8 i cant get a loan for a dollar i have no credit.
i should just go there and say yea i want to drive off in a evo8 right now lets go and when they find that noone will approve me after 3 days what should i do lol

Sorry no major update. I called the dealership a bit ago and spoke to my sales man (a great guy and seems very genuine BTW) and briefed him to get w/ the sales manager in the AM and to come to me at bottom dollar to make this happen. They made too many promises that they need to keep.

Tommorow will be the big update.
 
This happens a lot in dealerships. Be forceful with them. Don't take it out on your salesmen (Even if you end up with a higher cost he's not going to see it in his commission). This is the F&I persons problem. He messed up. He has a book with all the requirements for loans from all of his lenders. Give him hell but not the car.
 
Sorry no update after all. Were at a stalemate. Neither one of us will budge.

Heres the kicker, I can drop the car and be done w/ it and he can take a decent sized loss on it w/ the miles weve racked up to the next buyer, OR he can do that w/ us since we TECHNICALLY have no deal right now and they did promise there would be no problems. :rolleyes:
 
I think the power play for you is to give the car back and force them to take the loss.

Other option is to get outside financing and bluff that you're doing the above, negotiating an additional discount in the process. Be prepared to walk, though. If you have to take a long drive for another, do it. It'll be another brand new car and you'll have had a free loaner for a while.

Remember- the car has been registered and driven, it is used. If they have to re-sell, it will be several thousand less than the price they'd be able to sell for new.

I'd say you hold pretty much all the cards here.
 
I agree and thats pretty much where I stand. I left the dealership the other nite and went 10 min up the road to the next Mazda dealer and looked at another to buy. The b**** is I went to the 1st place cuz they had yellow. I may have to drive 100 plus miles to get another yellow. The only other yellow one I know of is at the 1st place. :mad: Maybe Ill try a different color. I just like the yellow since it grabs so much attention. That and Ive always liked yellow.

According to Mazda USA site there are TONS of MSPs in all flavors in Orlando...I may have to take a ride. I think its like 94 miles according to them. And Im like 15 miles from the zip I entered out of habit. (recently moved after 9 yrs in the same place, hard to get used to a new address. ;) )
 
Yup Corey Fairbanks has lot of them in stock. When I bought mine from classic they must of had like 12 instock. If you stop by Classic East look for Levert...hes the dude that sold MSP to several owners...cool guy!
