How do I fight this completely BS ticket?

Earlier today I was driving to meet my girlfriend at lunch, I was way early so I was taking my time and enjoying the sun, Most definitely not speeding.

I come up on a group of cars going about 50 in a 65 and then I notice there is a cop next to them driving the same speed and it's clearly obvious none of the cars wanted to pass the cop in fear that if they do they might get a ticket.
So I am forced to become one of these cars driving 50.
The cop speeds up and resumes normal speed and the other cars follow, Then he slows down and gets behind me and puts his lights on. I'm thinking to myself WTF is the ticket for, I must have a flat or something, Maybe not all cops are douches. So I pull over and he tells me I was following too closely and that I will receive a citation.

I was most definitely not following too closely and about 3 seconds after he said it to me I realized that since no one was going to speed he was determined to write a ticket and because I was forced to crawl forward at 50 because of the cars in front of me he decided to be a prick.

I was not breaking any law in anyway.

I plan on fighting this because I just finished defensive driving for another ticket I actually did deserve, My question is should I get an attorney, And do I need to call before I show upto the court. I've been told that if the deputy that wrote the ticket doesn't show up then it will be dismissed, So I don't want to show up on the deadline since the ticket says on or before I want to go to court in the next couple of days.

Damn that sucks but trying to defend a ticket when you just got out
of another one might be tricky.

Im with Bu11dogg2 on this, get a lawyer.
 
KILL HIM IN HIS HOME WHILE HE SLEEPS!!!! Then he cant show up to court and you will be off the hook. ;)
 
Get a lawyer. This isn't the place to get legal advice...everyone thinks they know everything.
 
Good luck man. From my point of view, it sounds like unless you do get a lawyer, you are going to have a hard time defending this, especially being so close to the last ticket.

Good luck though and don't give up.
 
Common ticket. This is what I would do:

Show up, plead not guilty. If the cop doesn't show on your court date the ticket will probably be thrown out.

If it doesn't, ask the clerk that your ticket gets put before the judge again (they usually will and you'll go back up at the end of the court call). Explain that you do not feel that you were following close. Note there were many cars and that the office may be mistaken. With that the worst you will probably get is supervision and/or driving school.

Keep in mind I'm no lawyer, but both my brother and mother work as county clerks in IL.

Do what bad hex said. Put on some dressy pants, and shirt with buttons, brush your hair, and address the judge in a courteous manner. Tell him your side of the story.

How far were you from the car? In Va I think they require you to maintain a safe following distance of 3 seconds. I.e., you pass a point on the highway, as the rear bumper of the car in front of you passes the point, you should be able to count to 3 before the front of your car reaches it.
 
yo, something stinks of BS here. i would definitely get a lawyer to get your back, because that cop is completely out to get you, man...

remember: tailgating IS a serious moving violation, and if he insists on it and it's your word against his, you're basically SOL.
 
Not sure about out where you are, but here, those types of citations are at the discression of the officer. Doesn't matter if you really weren't following to closely, if he thinks you were, then you were. As much as I despise TTAC, they do a good write up on why its a good idea to get a lawyer as opposed to fighting it yourself, though those are speeding tickets.
 
If he was that big a dousche to give you the ticket, he's probably going to show up in court. You can count on that. I say hire a lawyer. I wish I did. I got busted for "street racing" in this. I was not racing by the way. I did have a straight pipe from the header back, so it did make A LOT of noise!!

Judge was a arse. I dressed nice, addressed him very professionally and courtesly. As soon as I stepped up to the podium thing, he looked at me and asked if I knew the legal def. of street racing, as he opened his big book and read off,

"Street racing is accelerating in a manner as to not allow a vehichle to overtake you."

So, technically, all the jerks that speed up when you put on your turnsignal and try to merge onto the highway are "streetracing."

Shoulda got a lawer. I paid over $600 that day and thought I was done. Week later I got a citation in the mail from tallahassee saying my license was suspeneded for one year. Judge didn't know about it. I called Tallahasee and they said it didn't matter if the judge knew or not.

I say get a lawer!!

how much is the ticket? Following too closely sounds like it would be a small fine and no points, you probably wouldnt even have to report it to insurance and it might not be worth the hassle of paying a lawyer. If you really feel slighted you can go to court and plead not-guilty. IMO, if the amount of the fine is less than the cost of the lawyer (and no points) then dont waste your time/money
 
Be sure to document everything that you remember. I fought a ticket once where I was 1000% in the right. I figured I could just tell my story and all would be good. What I didn't expect was the cop to flat out lie.

If I had taken pictures of the area and explained the situation using them, I would have gotten out of it even though he did lie like an ass.

The moral is to be prepaired for anything. Even a cop lieing in court. It can and does happen.

when it does, you're completely SOL if it's your word against the cop's, because the court ALWAYS takes the cop's word over yours...(bang)
 
i got my first ticket for what i call "having a cool looking mazdaspeed3"... you should see the crap he wrote on the ticket for "not signalling while changing lanes"...

cops should be tested for being an arse-hole and barred from practicing if the fail (which this one would have), imho...
