Guy gets SCREWED from buying his LanEvo on Ebay.

If I had won the ebay auction which is a legally binding contract for an evo with extra work done to it and was told the same thing he was I would be pissed to. Its the dealerships fault they didnt realize they messed up until the auction ended -- they should not take this out on MarkD. The car was "sold" to the winning bidder thru ebay and if it was sold prior (which apparently it truly wasnt) the dealership should have ended the auction before it closed - then there wouldnt be any issues.

IMO its what i thought when reading it. Maybe i read it wrong but i just picture him being a little wousy.
Sorry. But thinking about it now after the fact i probably would have done the same thing.
I just wouldnt beg to get the car. Just go to a different dealer and get what you want.

Yes they can CANCEL the auction at any time .. but thats while the auction is still active. The auction closed and MarkD was the winner. That is where the problems arise.

Perf -- he isnt begging -- he hasnt even stated what he is doing yet -- the only thing he has posted is what the dealership has been telling him. The law right now is on his side and that means he should get the car in question with all of its mods at the winning bid price. I personally wouldnt drop the subject and go to another dealer to get a lesser equiped model for that price -- if not more.

as far as that show one deal and get to the lot and its just sold...

that is what is called "Bait and Switch" and is definitely a crime. business law, its a good class... its hard to prove that there wasn't a car there but it is a crime and can be proven. (if there was one car and it sold for that price and people were coming in later that would still be legal).

sux for that guy, wish I could help him but I can't so I guess I'm done... :D

the guy has a legitimate case. He bidded for the car and won, and the dealer won't give the car up

he has all the right to pursue this as far as he wants to

btw, that thread now has 96 pages and 556000 views!!! :eek:
 
we all should send emails to that salesman, because of guys like him, ebay(or internet) vendors are losing credibility and ppl are afraid of buy things from internet.
 
it's a two way street! if this guy had reneged (sp?) on the deal...man that dealer would have been all over him. a deals a deal...well almost, in this case. i don't think the dealer had a reserve on the aution either??? guy got screwed!
 
protege5gurly is right, they could cancel the auction at any time. once the auction is over, though, it isn't an auction anymore and is a legally binding contract (as it states all over ebay), which cannot be cancelled at any time. that is really the recourse he can take, they agreed by listing the car on ebay that they had it (ebay user's agreement), the auction was allowed to end, it is a contract. end of story. it's not like the bait and switch because there is no contract in that before the switch. maybe the guy was trying to pull it but he should've learned the law before doing that. hopefully he hires a lawyer and the dealership gets what it deserves.

and i'm sure the dealership has gotten its share of emails already about it, i doubt more will help anything.
