Got Ticket!!!?!?!?!?!?!?!

I got a ticket for "promoting racing" i was just sitting watching the car was parked and turned off. The cop said the ticket is 1500.00 and 5 pts. I am going to court and fighting this. Its rediculous. I wanted to know if anyone from NJ new if that was true or if he was trying to scare me. It worked.
 
You got a ticket for being a bystander? Was it just one race, or were you at the illegals?
 
New street racing policy. We have something similar in SoCal. If you're dumb enough to attend an organized street race, you'll likely be blocked in by 30+ police cars and everyone there will be issued citations and many, many cars will be impounded. Bystanders, even without cars, also receive stiff fines.

That's how it is up here too. That's why I never go to them. Besides the fact that there are hella haters there, the cops don't mess around.

I really don't see how they can assess 5 points if you received a ticket for a NON-MOVING violation. I know you get 5 points if you are caught "Racing on highway."

I'd call an attorney for a consultation.
 
It was in jersey city... and i have every intention of calling an attorney... there is NO ******* way in hell i am paying that ticket.
 
Same thing here in Philly, that if you're around the "races", you can get a ticket. That's why I don't even get NEAR them...
 
I agree with emt, as a NJ registered vehicle driver it's not possible to be issued that point amount for a non-moving violation. However, the fine sounds about right depending upon the size of the 'event.'

You may also wish to contact your congressman and make sure to get any news on recent federal mandates. It'd be a lot cheaper than contacting a lawyer only to find out there's nothing he can do for you.
 
no you should have been issued a 250$ bytstander ticket and thats it happened to me once but i got out of it because i know a large portion of the dover police force hehe :D
 
thanx guys... dont worry i am going to court for this and getting an attorney. i will pay 250.00 for a lawyer just to prove apoint that i wasnt doing anything wrong. I was parked. Last time i checked being parked isnt a violation.
 
yo..i know jersey laws well..that new street racing one is rediculous..they want to make sure all the ******* rich boys with bmw's dont race..******* chumps..yea..fight it man..call a lawyer..it'll be dropped..this happened to a friend of mine not too long ago..its all rediculous s***..my advice..smoke dust..kill cops...worship satan..
 
The 5 points makes sense if you were involved in the act of racing according to NJ DMV code 39:5C-1

There is also another code related to racing which yields 5 points as well (39:4-52).

According to my buddy from HS who is now a statie on 287 he said that the fine amount can vary depending upon location, amount of vehicles involved and your involvement. It could be as little as $100 or as much as $5,000 depending upon the scenario.

Car impoundment for a 24-72 hour period is also common.

39:4-52 is the old statute for "Racing on Highway" that carries a 5 point penalty.

39:5C-1 is the new statute that is usually given to bystanders, but can also apply to the participators as well. It's a disorderly persons offense, a misdemeanor with no points on your license. If you participate in a race, you cannot be convicted guilty of both 39:4-52 AND 39:5C-1, because it would mean being punished twice for the same crime.

39:5C-1 "Racing or making of speed records; penalty"
A person who shall operate or attempt or agree to operate a motor vehicle on a public highway in a race with any other motor vehicle or for the purpose of making a speed record or who shall arrange for, manage, encourage, or assist in, the holding of, or the attempting to hold, any such race or speed race event, is a disorderly person, and, upon conviction, shall be punished by a fine of not less than $25.00 nor more than $100.00 for the first offense and for each subsequent offense a fine of not less than $100.00 nor more than $200.00 or by imprisonment for not more than 90 days or both.
