Estimate price? (car accident)

Even Bijou-MP5 didn't have the turn singal but so........, when u r driving, u should always keep certain distance to the car in front of u in case of somethings happen ahead......., specially in San francisco, most of the drivers don't use the singals.....(of course i'm not one of those.....hehe)

i dont know how it is in the rest of the us.. but in cali if u get rearended its not your fault.. i had some dummy in his rice boy typr r blinkee light civic yank up his ebrake an try to whip a turn in front of me.. well the 1.5 dx civic didnt have the juice an i smacked him.. i was pretty upset.. but overall it was my fault.. if i would have left the proper number of car lenghts between us i wouldnt have hit him.. after all when u take your drivers test it even gives u a quiz on how far u are supposed to be from another car.. bad thing is.. most people dont follow it. -=)

Well, in Texas, it's the same. 2 of my friends were in the same situation: one of them had been hit from behind because the lane my friend was in was a go straight or turn right. My friend was turning right, and I guess the person behind her wasn't paying attention and hit her.
My other friend was driving at night and crashed into a van without its lights on. It resulted that it was his fault (which was kind of stupid).

oh well... Their insurance company (GEICO) won't pay me up.
they are giving me so much bs, telling me it was 3 lanes or something, even though it wasn't. it was wide enough to one car make left turn and one to go straight or make right turn. they are arguing that I was making right turn from middle of the lane.
there are no white stripe lines to divides how many lanes they have.
They are disrespecting police reports, so I called up for an attorney and decided to take this case to small claim court.
of course, hiring an attorney will be my own expense but I will think it as paying deductible for my insurance comp and make other drive to pay for my car damages.
anyone who has geico, becareful, they are the company who tries to take your money away and buy stuff for their geico lizard.
:bs:

If you win they have to pay your attorney fees. Just add that in to what you are suing for.

That's what I thought, but my attorney told me any property damage claim without injury, he said he can't claim for reimbursement for attorney fees.
hmm...Maybe I should ask him again.
or try to call different attorney.
thanks for reminding me good point ben ;)

I'm sure he know's better than I do. I think it may be different for each state though.

in Texas there's so many lawyer comercials that say that if you win you don't have to pay them.

I can't wait til Spring Break... Hey big_ben how close do you live from Six Flags?

I dunno anything about attorneys and stuff like that but I hope everything works out well for you and you are paid the amount you deserve from all of this.

I don't think anyone here on this board can say it was bijou's fault and crap like that.... even if the road was really wide and all it is always the person behinds fault unless we are talking about a lane change.... but this was not a lane change..
it is the a-holes fault that hit bijou and that person did not admit fault to their insurance company which made all this crap happen.

man i really feel for you, especially since you did nothing wrong and have to put up with all this s*** that you are in now....

if you know the guys address and know some gangs... (which I'm sure you do since you are korean ;) ) then its time to go pay his car a visit.....
or just get some dog s*** and lodge it under his car door handle....

Thank you for your support.
in these days, I get so much stresses. But, I finally hired an attorney.
175/hr for office work 200/hr for court work. i'm thinking between 500~1000 for an attorney.
I don't think year 2003 is my year. too many bad things happened so far.
i don't know if I can afford to get gangs though ;) lol
just wish me luck guys...

Bijou,

Hey buddy, what's up? You were right about the headlight thing not being as important as all the other accident bulls*** as I have read here on the board.

There are a few things to remember about IL state from past accident history:

a) If you were rear ended it is the other drivers fault no matter what. If that driver has no insurance, the state will go after him while your insurance helps you.

b) If you have no insurance in the listed (a) above then until the state/nice insurance firm (back prorate bulls***) can secure funds from said driver they can't really help you

c) If you had no insurance, no matter what, and an attorney presents your case to the judge, no matter what, the judge will throw your ruling out of court and you just spent some money with the attorney.

d) If damages are less than $5,000.00 in the state of IL and insurance was impending on the closure or late payment (check in the mail) there is the borderline possibility that you will be stuck with it...

What does all of this mean - be weary of the attorny fee's and use your own discretion how much you would be willing to spend and/or lose. In addition, I have a friend who is a body guy. He works in a body shop and has his own outside of work. He has been doing this for 20 years and has done all my body modifications and/or repairs at about 50% the lowest rate you can find. I'm sure he can help you. PM/call me. You know how to.

hi brian.
actually, that nice info you provided scared me.
anyway, since other driver's insurance comp decided not to pay me, there's possiblity they will be after me for their client's car damages.
that's why i hired an attorney. you know, for my own safety. also, that way i can prevent from other insurance coming after me and make them pay for my car damages.
I will definetely take your advices and I will be careful with fees.
As soon as this case resolves, I will let you know and ask your friends to fix my car and if he gives me good price, I'm sure I will spend extra money to you and your car. ;)

Hey!

Good point in hiring an attorney to cover your ass. Didn't think about that one. I can give you Randy's number anytime you want it - of course, offline. Just let me know.

Regarding my car, I have realized that I wouldn't mind getting an axle back, better the RS*R catback, and Tokico shocks/spring combination of sorts.

More importantly, get your s*** together, so we can roll together.

- Brian :D

P.S. For all you morones, Bijou's name is Chris and HE is a guy, not a girl (i.e. avatar picture is his girlfriend). :wtf:

for ppl who's friends of my gf, any posts with kissmarks (k) or winky ;)posts will be hers, not me.

wow I definatley thought you were a girl throughout this whole thread, no offense. But yeah, if you guys go to court and they find out you didn't have insurance at the time, I'm pretty sure your case will definately be thrown out. You're in a tight spot.

I rearended this lady in heavy traffic, I don't konw really how It happened, just followed too close to the person and coudln't get stopped. Well she had a new explorer sport track thingy, only 6 day's old. I thought for sure she was going to be pissed but the only thing I didn was scuff the grey rubber part of her rear bumper, so she was kind enough to let me pay for it out of pocket. ONly like $200 to replace it. So I would always give a person a chance to pay for something out of pocket. I know how much It can hurt you not to do it that way. My insurance would have went up 25% if she claimed that on me. So as far as claiming goes, I would leave that to a judge of character basically.

Well anyways, Good luck with everyhting. I hope everything works out for you.
