i say ship him the wheels that you have back ( with a conf. signature ) and have the charge over turned by your cc company...let him find his wheels.

credit card companies always fight to protect their customer, they could care less about the other guy unless there isnt sufficient information that the seller did something wrong.

call up your credit card company and they can do a chargeback
 
by any chance, is your cc company amex? They sure do take care of their customers. It is almost scary to merchants when customers are using amex lol.
 
seller is not responsible... as a buyer of an object that required shipping you take full responsibility for the item once u buy it... sorry but u got ****** dude

I just read this...this statement is completely false. Part of the sale INCLUDES getting it to you...it is the seller's responsibility 100%. Think about it. You don't buy a part from the ProtegeGarage, then have to arrange for your own shipping. They take care of it for you...if it gets lost, they take care of it for you and then go after then shipping company for anything they are out.
 
The responsibility depends on the sale here folks. My company ships things to our customers FOB only. Freight on board means that once its left our shipping bay, it is theirs, and we are no longer responsible for it. IT depends on what the agreement was. A smart seller will put "Not responsible for damage durring shipping or lost/stolen packages." . I see it all the time on ebay. A smart buyer will pay the extra $$ for insurance.

Now in a dispute the burden of proof is up to each party. The seller must be able to prove he/she shipped it correctly, and the buyer must be able to prove otherwise.

If the seller did everything as he was supposed to and did insure things correctly then you are in fact SOL. I'm sorry but it UPS ****** this one up, its not his falt.

However if he is the one who made the **** up, then it is indeed his responsibility and he should take ownership for it. It sounds like in this situation it was.

As for the TPMS sensor and tread issue, that is his falt. A used set of TMPS sensors is about $100-$120, new they run over $200. You should save a copy of his add, all emails between you and him, and take photos of the crappy tires and missing tpms sensors so you can prove you didnt get what you paid for. Then do like someone else already said and send them back, insured with signature verification. Call ur CC company and do a charge back. Watch out for paypal. If they are connected to your account they might try and take the money out of ur checking account to recoup their loss. If you can prove what happened you will be fine.

What cjms3 said is just retarded. By looking at this situation as a whole, you can tell that the seller had an intent to rip someone off, advertising their product in better condition than in reality. When it came down to shipping, the seller really cheaped out. You know it cost $1 per every hundred you insure, and the $100 insurance is a default policy, you always get it on anything you ship through UPS, you can't even waive it.
As others said you should definetely dispute the charge with your CC company. Amex will get it back no matter what and so will other major CC companies like Visa and MC. Good luck to you on resolving this issue.
Btw, if something like this happened on nissan forum board the mods find and post personal information about the seller on the net. Things like name, IP address, residence address, and so on. I say we do that on here.
