I think you should respond that you have every intention of making the site a user forum promoting the game, and site design is in consideration now but can not be completed and programed until after the game has been released.

However, having received what you percieve to be a threatening letter from them, you are now considering making the site an anti-Madden site or selling the name to ESPN games.

I have no doubt you could get a good lawyer to take you case at no cost to you. There is a very good chance you will win and most lawyers will see this as an opportunity for them to gain press and money. It's a win-win situation for them.

You should also put something on the site now. I suggest this problem. Put up a page explaining the situation and how you now feel betrayed by the corporation you had previously put faith in. Have user's vote whether you should continue the plan to put up a pro-madden site, or an anti-madden site. This would be a great Viral site and your hit's would probably jump up in no time at all. This would re-inforce to a judge that you have been using the site for a legitimate purpose should legal action later be taken. They can't say you are squatting on a site that has recieved several thousand hits (statistics you can get from your hosting company)
 
Actually, first I would get a contract attorney. Then respond to them with "All negotiations should be held through my legal advisor. He can be reached at:..."

It's going to cost them a lot more in legal fees than you. They know it, you know it. They are trying to avoid going that route and still scare you at the same time.

Plus the legal battle could take years. If they don't have the site url in their possesion it could cost them millions in online advertising, pushing back product release dates, re-doing packaging and promotional items on top of all the legal fees. It would be in their best interest to pay you significatnly more than your investment and a few games. Think of the big picture here.

well honestly, they CAN do whatever they want. they have millions, you have.... not even 1 million. they can get lawyers to maul you while your bad lawyer cries.

He still owns it, but the judge ruled that he is not allowed to use it for his business. He has a legitimate claim.

And how much did Nissan lose in business due to not having the domain name? Plus nissan's website is a name they'll keep as long as Nissan is in business. It's worth it to them in the long run to fight for the domain.

Madden06 is unly usefull to EA games until Madden 07 comes out.

Let see: Loss to a car company for as long as they are in business vs. loss to a game company for 1 game for 1 year.

The two scenarios are not even comparable.
 
I'd take premium $$$ compensation for the domain and possible lost advertising funds, plus a copy of every game from their entire library.

That was my plan to promote espn football or offer the site to them first then i thought about the new shoe line for the year 2006 for Steve Madden Shoes. My girlfriend wears them all the time. I also sent out an email to this site in the UK to have the value of the domain appraised. Im still waiting they just responded with a new offer

I responded to the email. With the Idea of having a message board underconstruction With tips and tricks to promote there video game. I told them that i had no intention of malice toward the John Madden video game line of products.
 
What gets me is a multi million dollar company didn't buy madden01-atleast 10 in the first place.

Its their stupidity. However you are pretty screwed. They will throw thier money around and get what they want. However you can be a fool and represent yourself in court! AND that won't coast anything but your time. you will loose but atleast you made them spend thousands in order to get it!

Secure the site through legal action? They could've registered the names for what, $30 for 2 years. Registering is dirt cheap, I'm sure they'd be able to fork over the $500 to register a bunch of names.
 
Personally, I don't think they'd be willing to pay a hefty some for the domain. But let's say they did, well everyone and their mama is going to start buying out domain names for the next million years. I would just take whatever they are offering you. But that's just my opinion.
 
I appreciate all the feedback guys there were some good ideas. Im going to go over everything i will keep everybody posted as to whats going on.

Exactly. That's why you should sell them the domain but their offer should AT LEAST be $1000 or more. $1000 for a huge company like EA is NOTHING.
