Warranty Woes WTF!

I have a 2003.5 Mazdaspeed Protege that I have had for about 1 1/2 years.
Recently
I test drove another car (at a subaru dealership) and had them assess the trade in value of my
Mazda. When they came back with it they asked me "when the accident
happened". I have never been in an accident so I knew nothing of this.
They
then informed me that my drivers door had been repaired and both doors
had
been painted. The car salesman that I was dealing with stated that they
pulled a carfax on the car and nothing came up so it must have happened
either at the factory or at the dealership. (The car was a dealer trade
from Chicago).
Upon further inspection, it has been determined that my drivers door
has
been "reskined", has body filler in it, and is rusting from the inside
out
as well as cracking.
I brought this to the attention of the dealership that I purchased it
from
2 months ago( Subarban Mazda of Troy). Immeadiatly after talking with
the
new car sales manager, I got a call from the used car manager that had
done
the original assesment and then he assured me that he did not run a
carfax
or devalue my car due to the repairs.
I was then directed to the service manager to look into getting it
repaired. The service manager stated that he would have to deal with
the
Mazda North America Rep to get the repairs authorized. At that time he
stated that the door would get replaced and the car would be repainted
on
that side. He stated that he would arrange a meeting with the rep the
next
time he was in the area.
After waiting and calling him several times he finally got back to me
and
stated that he had met with him and needed to get pictures of the car.

weeks ago I took pictures of the rust and cracks (because the
dealership
camera broke when I went over there for him to take the pictures), and
sent
them in.
While this is happening, Both of us notice a stress crack that has
formed
in my windshield. I took pictures of that as well to be covered under
warranty.
Again after calling several times to get status updates and not hearing
anything other than they were waiting on the rep, I finally called
Mazda
North America's customer line.
They stated that the rep was at my dealer and that I could go there
(today
@ 11am) and that he would be there for a couple of hours.
Upon arrival I waited 20 minutes to talk to him, (he walked past me
several
times doing nothing before he introduced himself), He then proceded to
tell
me that he had already authorized my door to be repainted. He stated
that
that was all I was entitled to as the car has 25300 miles on it. He
sated
that when the car had left the factory, it had no damage and he was not
responsible for anything beyond that. He also stated that he would not
warranty the windshield because of the mileage. (there is no rock chip,
it
just cracked).
I explained that I payed for a new car. What I got was one with a
repaired
door that is rusting from the inside out and a windshield that cracked
on
it's own. All I asked for is the door to be replaced with a new one,
have
it painted, and have the windshield replaced. All he wants to do is
repaint
my door.

I have been dealing with this for over 2 months. I have been getting
nothing but the runaround. I believe that I am the victim of retail
fraud.
(they never disclosed any of the repairs). And now they won't warranty
the
windshield and they only want to paint a door that is rusting. WTF? Anybody got any advice on this one?

you need legal action if they did not disclose the car had been repaired, thats just ******* bulls***.

Seriously though, I was thinking that the lawyer route might be the way to go.

It just seems unbelieveable to me that they would be that unresponsive.

Has anyone heard of this kind of crap though? I don't know what burns me more, the fact that they did a half arse job of repairing it and there was no disclosure or the fact that they are not willing to do anything about it now. (a paint job is NOT the answer)
I am seeing a trend of not doing the right thing....
 
Pay a lawyer to go in and talk to teh guy, he will be signin a new story soon enough
 
Just get a spray bottle of brake fluid and go by the lot late at night wearing a baseball hat really low on your face with some clothes that you'll only wear one time and then spray all the car with it. You'll get your sweat revenge when all the paint comes off the dealers cars in the morning. Make sure it's a nice hot day after you do it though, that way the stuff can really eat the paint off...hahahahahaha!!!!!!!!!!!!!

Don't get caught because you'll probably end up in the pokie....

But really, see if you can find a lawyer to give you a free consult and see if you have a case, most lawyers do that here in Vegas. Some will even take the case for free up front if they think they will win. They will collect on the settlement.
 
lawyer, Better Buisness bureau and the MOB as a last resort

but, as said before, welcome the bull crap of mazda warranty.
that may the reason why i will never buy a car from the EVAR again.

Honda on the other hand fixes and licks my arse when there is a warranty issue. they don't even care, just make me happy. and i love them for that!!!
 
Is your protege Yellow? I work at a mazda dealer in the chicago area and a employee had a yellow speed dealer traded to us to purchase. We noticed that the car was damaged and had bondo all over the drivers side door and informed the kid not to buy it. They ripped him off on his deposit and he didnt buy the car. Im wondering if you got the car that we had. If so Ive seen the damage when the car was new and unsold and it came from the original dealer it was shipped to. You can trace the car to the original dealer and hold them responsible. Ive seen this before, car get damaged on the lot and the dealer fixes them and sells them without imforming the customer.
 
i dunno about the state your in but here in texas we have a lemon law where if a dealer miss informs you of ANYTHING that they knew otherwise on, the car can be completely refunded. might check into that. i think they created it due to all the dealers trying to sell new cars they knew had been flooded in rain storms and not telling the customers.
 
No, Mine is Titanium. Sounds like the exact same thing though.

Talking to lawyers this week. I'll post as I get updates.

How is it that I can hold the original dealer responsible? Mazda N.A. has no record of it being repaired. My dealership has no record. Carfax is clean.

I am thinking that this was totally an off the record kind of thing...

Hi Hase,

If you look up my posts you'll see I've had my share of run ins with Mazda. I just noticed in the Warranty Manual that it has a section for disputes. You've already dealt with the Mazda rep and are unsatisfied. You can now go to arbitration as stated in the manual. The arbitration is done by a third party, I would think if you can't get satisfaction then to look into a lawyer. No sense in complicating things and adding cost if the 3rd party can help.
