Ufo Hit My Cx-7

I was driving down the highway this morning, a Taxi cab ahead of me hit debris or some type of UFO that blew out his tire. His tire launched this UFO right into my windshield, I saw it coming in slow-motion but could not move out of the way.

I have attached a pic of the damage for your viewing pleasure, did damage to the front part of the roof too, this stinks.

The Taxi driver and me pulled into a rest area just ahead at which point I called the cops, he said to exchange info. and call our insurance. Is the Taxi driver to blame for this?

Sorry for the damage. I don't know the circumstances but I don't think the Taxicab driver can be held at fault. It is an accident. When he hit that "thingy" and launched it to the air, he cannot control the trajectory path for the launched "object" and whether if you're following too close or cannot swerve, it is an accident. I think it's the taxi driver's fault, but then again, I am not state farm =p
 
The taxi driver is not at fault. Depending on your state, it should be filed under your comprehensive coverage provided you have it. It should show as a "not at fault" accident. It's like you hitting a deer.

To have the taxi driver to be considered at fault you'd have to prove negligence. He hit something in the road. To me, he acted with ordinary and reasonable care in this instance. Meaning, he did not intentionally hit the object in hopes of causing damage to your car.

I've been out of the insurance game for a while but I'm pretty sure my info is still solid.
 
Holy crap! I'm glad it didn't hit the windshield at a point near your face. You might be removing glass shards from it if that were the case. Crazy
 
Awww man, I'm so sorry to hear about the damage. What terrible luck. Your insurance will prob cover it (hopefully w/o a rate hike) but that's still a bad break. I hope the repair process is quick and painless. And I'm glad you weren't hurt.
 
Wow. That sucks, I can understand the slow motion aspect. I got hit in the windshield by a stone about 3-4 inches from a gravel truck, I saw it coming and BANG. My windshield cracked every which way but it didn't shatter, good thing because it was the dead of winter and I was 100 km from the nearest town at the time.

Hey, have more confidence in the CX-7 and modern engineering. The CX-7's windshield is thick. Also, even if the windshield shattered, he wouldn't be impaled with shards. The glass on vehicles are tempered and are designed to shatter into harmless glass beads that won't cut/impale people.
 
The same thing happened to me, only it was a tire that flew out from under a Tahoe and it hit my bumper instead of my windshield. Insurance placed it under collision. If your car is moving and it strikes something, that's what you can expect. If the object hit your car while your car was sitting still, it would be comprehensive. What sucks is that I have $500 collision deductible and $50 comprehesive.

Hey man, ya never know, those fragments sometimes come off pretty angularly, my girlfriend worked as a lifeguard and had to fish out three tempered glass table tops worth of glass from a swimming pool once, she ended up with cuts all over her feet and hands from it.
 
Bummer man that looks horrible. But like said it's not his fault it got tossed into your car. Now if something blew off his car and hit your car then it's his fault like some cars in ohio that have rusted ass cars that have duct tape holding them together since they have no state inspections and his bumper flew off smacked your car then yes it's his fault. But hitting debris in the road and tossing it into another cars path isn't your fault.

Prime example had a lund visor installed on my F150 and it blew off broke the fiberglass right at the brackets. It was run over by a car behind me we both stopped but no damage so I left.

But anyways I am sure you have comprehensive insurance on the car. So unfortunately you will be paying your deductable whatever it may be but that windshield is close to 650 bucks. Just got one quoted for my wifes CX7 when a rock chipped it. Thank god it was repaired didn't feel like paying our 250 deductable.

I'll bet it goes no-fault so you're responsible for your damage and he's responsible for his damage. Seems to be the fair thing imo.
 
Car fixed

OK, so I got my car fixed and did not have to pay a dime!

My insurance somehow convinced the other guys insurance that his tire blowout caused the damage to my car and covered everything, even the deductible of $500 bucks.

I did have to pay about $400 in a rental cuz it took the body shop 10 days to fix the car, initially they said about 4 days.

Looks good as new.
