Transmission Slips @ 4th gear

Can anyone help? My 07 CX-9 AWD transmission slips, everytime it gets up to the 4th gear it will let go the gear "feels like in neutral with high RPM about 4,000" then grabs back with a jerk and then shift up to 5th gear. Trans fluid is now black but still level and it only does it on the 4th gear. Anyone have experienced the same or know about this kind of problem. Thanks in advance..
 
How many miles does the car have? If the transmission fluid is black , then you should have the fluid changed. It is supposed to be a light red.
 
It has 88,000 miles, Do you know what kind of Oil and how many quarts does it takes? does it have a Transmission fluid filter?
 
It uses mazda i believe is jw3309 or toyota t4 transmission fluid. It takes almost 8 quarts. They don't replace the filter i guess because it is a metal one. I had the dealer do it for 200 bucks. They flush and refill the tranny with new fluid. I heard there is a drain plug to drain the fluid. If you do that then check to see how many quarts come out and then you add the same amount back in through the filler tube. Make sure the car is in a level spot and go through all the gears and then pull out the dipstick and check the level of the fluid. Then add if needed.
 
Even at 88k, I dont think tranny fluid should be black, unless its filled with dirty metal shavings and such..your tranny may be shot. I would advise on going to a good transmission shop or dealer on this one.
