When did I say the light on the bumper blinked? When did I say the "accessory" light doesn't blink? Re-read my post and think about what you just said.

Let me make it easier for you. AMBER BUMBER LIGHT = DOES NOT BLINK = LEGAL REASONS. And for the other one: SIDE MARKER LIGHT = DOES BLINK = FOR SIGNALING PURPOSES = SAFETY REASONS.

It is legal because the bulb is at least amber. You can have clear lens but the bulb needs to be amber. Take the BMW 3-Series Coupes for example. Included in the Sport Package are Clear front corner lamps. However, there are amber bulbs in the lamps.

Auto Manufacterers and Retailers are not allowed to sell "illegal" merchandise unless there is a notice on the products. Take for example the "Not recommended for Street Use" and "For Show Use Only" warnings found on a lot of aftermarket accessories. If you're still doubtful, the BMW 3-Series Coupes when purchased with the Sport Package does not provide a warning. If the lamps were in fact illegal and BMW does not state so, they can be in serious trouble.
