so last month I was run over my some lady driving a brand new
4runner while I was crossing the cross walk with the light.

I was taken to the ER, got a CT scan, kneck xray & arm xray.
lucky nothing broken. Big contusion on my head & whiplash
type injuries to my kneck.

friday her insurance agent (progressive) calls me and says he
reviewed the case and would like to offer me $1k + medical
bills ($1700). :wtf: . I was laid up in the hospital (5 hours) and
on medication for a week. I have friends who were passengers
in a car wreck with minor whiplash injuries get $5k + medical.
I still have stiffness in my kneck.

 I didn't want to get a lawyer involved but this is :bs:
I want to get that insurance adjuster out here run his ass
over and see if he'd take $1k. They're gonna **** that girls
rates more than the money they are offering me.

They start low, tell them what you expect or you will see them in court. I would also be filing criminal charges on the b****.

That is what all insurance ajusters do. Low ball you on the settlement and see if you will bite. I work as an insurance agent and know that if you are really hurt, you can get 3 to 5 times the amount of medical bills as a settlement if you don't use a lawyer.
If you get a lawyer involved, the adjuster will put the claim on the backburner and it will take forever to get any money. And after the lawyer gets their 33% you will have less then if you settle without one. I would tell the adjuster that you will settle for $8500 or else you'll get a lawyer and see what he says.

Get a lawyer. Seriously. The insurance company will try to give you a settlement check and then sign a release. Then you are screwed for any future medical bills. Trust me you may have future problems. Let someone who knows the in's and out's out personal injury claims take care of getting your medical bills taken care of and any settlement you might deserve. If nothing else at least consult with one. Most have free initial consultation.

Hell back in 1988 I was bumped in the rear by another car. No injuries and cosmetic damage to my car and their insurance company gave me damages + $2k.

Yep that is normal, you can't expect companies to dish out lot of money from the get go. Of course they will try for a lower amount.

Lawyer maybe needed down the road, just remember to also sue for the cost of the lawyer. :) Course this all depends on what figure you are looking for?

btw sueing for a butt load of money doesn't do any good in the long run of things.
Just sit down and figure out what it has hassled you as and come up with some reasonable figure.

I have heard about that 5x figure on the medical bills.
personally I hate going to doctors and believe chiropractors
are all fakes. I would of taken 8k if he had offered me that
right off the bat. but he pissed me off with that 1k offer.
does he think I'm some piss poor new grad who'd jump at
any amount of money? he even gave me that crap about
having given the offer letter to his manager like it was a
big thing and had to wait for his "approval". I felt like I was
talking to a car salesman or something.

Oh and don't tell the adjuster your plans to consult or retain a lawyer if you decide to do so. They will up the offer to something that might look tempting at the time but is a far cry from what you might deserve.

Yeah, make sure you drive everyone's insurance rates sky high.

Seriously, decide what your pain and suffering, and any lost work or whatever is really worth to you. Don't just be a money grubber because you can be. That's the entire reason insurance rates are so high in the first place.

Yeah... like one guy actually getting money back from insurance is going to raise your rates...

P.S. It's just an exuse for insurance companies to raise them anyway!

I'm looking for 8-15k. I had my house move interrupted. missed
my sister's engagement dinner. which I found out later everybody
had a REALLY good time at. And the other pain an suffering from
getting hit. I doubt that would "raise" other people's rates besides hers.

btw. I know for a fact that progressive is a pretty cheap ins.
my coworker got rear ended by a progressive driver. they said
they would just paint and reinforce his old bumper and have the
body shop just re-weld his exhaust back together.

That seems completely reasonable to ask for. I was just saying don't listen to the people who tell you to ask for a quarter million or something outrageous.

Did she get a ticket, or did they call it a no fault or what?

Yeah, and he's the ONLY person in the world doing this. Wake up.

Wake up and smell the coffee... you rates are going up no matter what you or anyone else does!!!

Why are we even paying those radiculous rates if we can't get anything back from them when needed...

I say F them and dumb asses like you who brown nose the insurance companies!

Well the police report said she was in violation of the traffic
code -> failure to yield to pedestrian in cross walk.

the other kicker is that she never reported it to her insurance
company. I had to get the police report to find out all her info
and then call them and have them start it up. it was 10 days
after the accident.

Easy there, Tiger. Try some decaf.

It's simple economics. Insurance companies collect premiums and pay out settlements. If they have to pay out massive settlements, that money has to come from somewhere. If the woman has paid say $20k over the life of her policy, and the insurance company has to pay out $250k, where do you think the other $230k comes from? The insurance fairy? It comes from OUR premiums.

Don't they teach this stuff in school anymore?

So by your calculations the insurance premiums should at least quaruple after the 9/11...

P.S. Relax... insurance companies still make enough money... who do you think owns most if not all of the casinos in Vegas and Atlantic City...

NO need to get personal here gents. Different opinions are to be welcomed if presented well not insulted.

I personaly feel that grishulia is on the right track.
Insurance comapies are the most profitable industry in the world. Also they are the only company allowed to descrimnate against people based on race, age, sex and location. Not to mentin they are the largest lender of money to the federal governement and pay a huge mount in compane contributions to keep ther ability to discriminate. The insurance companies will always rasie rates becuase they can and no one is there to keep them in check on anything!

Insurance rates DID go up after 9/11 for a lot of businesses. A lot of other businesses lost their coverage and it's harder to get some coverage now. Same thing happens in the South after hurricanes, or in the Midwest after floods.

Well, MGM Mirage owns the MGM Grand, Bellagio, Boardwalk, Golden Nugget, Monte Carlo, New York New York, Mirage and Treasure Island. Park Place Entertainment owns Bally's, Caesar's and a bunch of other things. So, I'm not sure what insurance companies own, but I guess they could own something.
