New Mazda 5GT not happy-help

Three weeks ago today I bought a 09 mazda 5 gt with luxury package, I was so excited to fine the one I wanted white ext with black leather, still with the plastic on the seats it had never even been demoed-Perfect.
Over the next few days I noticed oil on my driveway I thought there was no way it could be my new car so we left for holidays. When I returned I realized that my 5 was leaking tranny fluid, so I took it in. They re-sealed the tranny pan. The next day I noticed it was still leaking, I thought there must be some residual on the undercarage. A couple days later I noticed it was deffinitely leaking. So I took it in again-they couldn't find anything! I put cardboard under the car for the nex few days and figured out that the car seems to leak more after a longer drive, so I took it in monday right after my wife returned from work. They called me the next day and said my tranny case leaking through the case and the transmission would have tobe replaced.
Then the bomb dropped! They are going to replace my tranny with a rebuilt one!

I screamed and hollered from everyone from the sale manager to the service manager and I called Mazda Canada, Everyone blamed each other and Mazda say they have fufilled their obligation by replacing the transmission and they will do nothing more! I have told them I do not want the car back as I would bet that that will not be the end of my problems with the transmission and my car in my eyes is devalued having a used transmission in a brand new car.
I even stated that this car should have never left the lot as this should have been caught on the PDI.

No one is going to do anything for me, I am thinking of trading the car in on another brand and taking some action against the dealer.

Does anyone have any ideas/comments?(chair)
 
Man, that sounds like a crappy deal, hope you can get it resolved to your satisfaction.
 
The service guy agrees with me but mazda doesnt supply new trannies! the selling dealer wont even let me pay to trade in this car!
Dont shop signature mazda in richmond BC!
 
I know this may not sound like much, but write a firm but fair letter to mazda corporate.
Send one to the CA HQ and one to Japan.

If they are willing to guarantee the trans as new for the length of the new car warranty in writing, then you should be ok as far as any future issues.

There's a BC Mazda based forum (not sure if I'm allowed to mention it here), post your experiences there. The general consensus there is that Wolfe Langley Mazda is the only non crookish dealer in the Vancouver area. Morrey Mazda is just as bad.

Gee, I didn't think zeddy was all that out-of-hand in asking us for advice on what to do. I for one haven't had anything like this happen to me especially with a new ~$25000 car. Do you work for a dealer (sorry, don't have time to search thru your 900+ posts)? At least we'll know where your point-of-view is coming from. Also, why are you certain that he'll get a new tranny?

As much as that sux, I would have to say that the only thing that counts, is that they will get your car fixed. I doubt you would feel any better if they say you are going to get brand new tranny, but in fact get you a rebuild one. You wouldn't even know that.
Not to defend the dealer or anything, but they are being honest with you and willing to get your car back on the road.
s*** happens, no question about it. Just try to take it easy, get your car fixed and enjoy it to the fullest.
 
So do you know for sure that they never did a PDI on it?

I am uncertain who actually "pays" for the PDI, the dealer, or the manufacturer. I have always wondered, perhaps a dealer employee could comment.

If it was the manufacturer, then I would make sure and let them know that they are not getting what they are paying for, and by doing so, have spoiled your image of Mazda vehicles.

So is the main problem that you want a new transmission, and they are replacing with a mazda rebuild? I hate to say it, but your Mazda5 has a used transmission in it right now.(sssh)

I have two close friend in the transmission business, they both say a rebuild is know where close to a new transmission and a replacement new transmission would never outlast an original properly cared for tranny that was installed at the factory. Even the service manager thinks I am getting a crappy deal!

You could ask for an extended warranty on the transmission, maybe 10 year / 100,000 miles (about 160,000 kilometers).

If that's not acceptable, you really need to figure out a way to put a price on the diminished value of the car with the rebuilt automatic transmission then ask for that money first by letter, then in the Canadian equivelant of small claims court.

If this also won't work for you and you really want a new transmission, talk to an attorney.

I am a car guy and this is the worst customer service experience I have ever had, I think I have a reason to be pissed!
I have recieved delivery of hundreds of new cars when I was a fleet manager and never had an experience like this!

+1 This shoulds very reasonable for both parties. I understand that you want a new trans for a new car. I have never purcahsed a new car nor will I ever. i'll let some other poor sap take the hit once they drive it off the lot. Once you get a new trans look into getting a trans cooler installed. it will make it last a lot longer really.

Explain the situation, be very clear, be well documented and keep it cool. It is frustrating, I agree, but everybody has customers at last and we know how it is. They should know how to respond to these things...

Else, I guess the Canadian owners above have given good ideas...

Depends on where the rebuilt units are coming from... If the rebuilder assembles with tolerance and part quality equal to or better than the original then I don't see a problem. The rebuilt unit may actually be better if it was assembled with upgraded components designed to address faults or weakness with the original design.

Simple comparision.... If you engine blows, do you want a new one or would you be comfortable with a rebuilt unit with forged rods and pistons....
