Instrument Lights don't go into Night Mode

I just bought a 2008 CX-9 (love it) and the green Headlight On indicator is always on in the instrument panel. Also the instrument lights do not dim or go into night mode when the headlights are turned on. You can push the dimmer switch manually and flip to night mode, but I wouldn't think you would have to do this manually every time it is dark outside.

Anybody know about this?

I have a '12. The green headlights indicator only comes on when the lights are on--maybe you have some type of short. My car "remembers" whether the instrument panel was dimmed for night mode from the prior time the headlights were on; not sure how the '08 is supposed to work.
 
Yes, That's how I assume it's supposed to work. I bought it used from a Ford dealer and they said it was a trade in from Canada, which requires daytime running lights. He thought that maybe it was programmed to have daytime running lights. I'm not sure this is true since the lights are not always on even thought the indicator seems to think so. Anyway, I think the indicator and the dimming issue are related. My guess is that the instrument panel thinks the lights are on.
 
Had or still have a issue with the dimming function happening too quick.
Took it to dealer they were supposed to set the programing to be a little longer.
I notice at times when I select daylight function to overcome the Night setting (Cloudy / Rainy day) that later that night I have to overide back to night time.
Think it might be normal or I have just treated it as normal.
This is also on a 2012 GT.
Just gotten used to doing it when necessary, I guess I just consider it a quirk of the machine
