My mother in law got a settlement notice in the mail a few days ago. It’s for her 2018 CX-5 that she no longer owns. Wanted to share here for awareness, see details pulled from the official source linked above. I replaced her screen last year due to the ghost touch issue and I still had my invoice from MazdaSwag. We’ll see if I see anything back from it.

If you are an individual who purchased or leased certain Mazda vehicle models (listed below) in the United States or its territories, you may be entitled to benefits afforded by this Settlement.

What Is This Lawsuit About?

A proposed Class Action Settlement has been reached with Mazda Motor of America, Inc. dba Mazda North American Operations (“Mazda”). The proposed class action, pending in the Western District of Kentucky, is captioned as Duffy, et al. v. Mazda Motor of America, Inc., Case No. 3:24-cv-00388-BJB (W.D. Ky.) (the “Litigation”). This lawsuit claims that the Mazda Connect Infotainment system in the Class Vehicles has technical glitches that cause it to reboot, freeze, become non-responsive, get stuck in a never-ending bootloop process, have unexpected audio or video errors, or otherwise malfunction. Mazda denies these allegations and denies that the Mazda Connect system is defective.

The class representatives and Mazda do not agree about the claims made in this Litigation. The Litigation has not gone to trial, and the Court has not decided in favor of the class representatives or Mazda. Instead, the class representatives and Mazda have agreed to settle the Litigation. The class representatives and the attorneys for the Settlement Class (I.e. Class Counsel) believe the Settlement is best for all Settlement Class Members because of the risks and uncertainty associated with continued litigation and the nature of the defenses raised by Mazda.

Who Is in the Settlement Class?

All persons or entities who purchased or leased certain Mazda vehicle models (listed below) in the United States or its territories.

The following models are covered by the Settlement: Mazda2 2016-2022, Mazda3 2014-2018, Mazda6 2016-2021, CX-3 2016-2021, CX-5 2016-2020, CX-9 2016-2020, and MX-5 2016-2023.

What Does this Settlement Provide?

The Settlement provides the following benefits:
  1. Limited Warranty Extension (LWE): All current owners or lessees of Class Vehicles will automatically receive a LWE for potential software updates or necessary connectivity master unit (CMU) repairs or replacements for a period of 24 months from either the expiration of the New Vehicle Limited Warranty, or for Class Vehicles for which the New Vehicle Limited Warranty has expired, the Limited Warranty Extension will run from February 17, 2025, the date the Court entered the preliminary approval order.
  2. Reimbursements for Out-of-Pocket Expenses: You may be entitled to reimbursement for any Software Updates for Mazda Connect and any repair and/or replacement expenses you incurred for the CMU, an SD Card, the Display, and the Rear-view Camera.

YOUR LEGAL RIGHTS AND OPTIONS

MAKE A CLAIM FOR CASH REIMBURSEMENT
Deadline: August 1, 2025 (Postmarked/Filed Online)
The only way to get a payment. Claim Forms must be submitted online or postmarked by August 1, 2025. Please follow the instructions included in your notice to file a claim. You may also visit the “File a Claim” portion of this website if you wish to submit your claim online.
OBTAIN LIMITED EXTENDED WARRANTYYou do not need to do anything to ensure coverage under the 24-month Limited Warranty Extension. If a problem arises with the Software or CMU in your Mazda Connect system, simply take your vehicle to an Authorized Mazda Dealer.
EXCLUDE YOURSELF FROM THE SETTLEMENT
Deadline: July 2, 2025
Get no payment. This is the only option that allows you to ever be part of any other lawsuit against Defendants about the legal claims in this case. The deadline to request exclusion is July 2, 2025.
OBJECT TO THE SETTLEMENT
Deadline: July 2, 2025
Write to the Court about why you don’t like the Settlement. The deadline to file an objection is July 2, 2025.
DO NOTHINGIf you do nothing, you will receive the automatic benefit of the Limited Warranty Extension, you will not receive any of the monetary Settlement Benefits, and you will give up your rights to sue Mazda and certain Released Parties for the claims this Settlement resolves.
ATTEND A HEARING
When: July 28, 2025 at 9:30 a.m. ET
You may attend the Final Approval Hearing where the Court may hear arguments concerning approval of the Settlement. If you wish to speak at the Final Approval Hearing, you must make a request to do so in your written objection or comment. You are not required to attend the Final Approval Hearing.

  • These rights and options—and the deadlines to exercise them—are explained on this website, and in the Notice available on the Important Documents page. The Court in charge of this case still has to decide whether to approve the Settlement. No Settlement Benefits or payments will be provided unless the Court approves the Settlement, and it becomes final.
 
The lawyers share $1.9 million while the plaintiffs get what, a check for $2.50?
The main plaintiffs got less than like $20k to split between the 3 or 4 of them (no joke). Really not clear if those who file claims will get full reimbursement or not. Attorney's fees disclosed but not a pool of money to split from my understanding.

The lawsuit has been scheduled for a hearing, so all the details aren't "blessed" yet by the courts.
 
Our 2019 CX-5 radio is starting to have the dreaded 'ghost touch' so I'm happy to see this. I'm still confused if the warranty extension is now in force, or if I have to wait for the court case? Anyone?
 
I got the notice but no longer have the 2020 CX-5.

In other news, my Mother's 2019 Subaru Legacy had the ghost touch issue, and her infotainment system was replaced.
 
Too late for me, already replaced the display. But I could use the 2.5$ to buy a paperclip.

If your out of pocket expense for the replacement was $2.50, then yeah, that's what you could be reimbursed for. Most people paid a lot more for the replacement, and would thus be reimbursed for a lot more.

You're right. To buy a brand new display from Mazda costs you, nowadays, more than 1.000 dollars. Plus labour costs, you're looking at 1.500 $ easy. My expense was 265.21 $ on ebay and one hour of my time installing it. I am not sure how Mazda can/would reimburse me and personally I don't think it's worth the headache.

It was pretty easy to submit the claim with the info on the postcard. I used the online portal and uploaded the pdf invoice from MazdaSwag, hit submit. $196 shipped last year for the K1Y3-61-1JZA display repair kit, it’s now running low $200s (if that’s the kit you need anyway). I’ll report back if it’s reimbursed. Couldn’t hurt to try uploading an eBay invoice but have to admit without the postcard, you’ll have to contact somebody to say you think you should be included.
 
Oh, i did receive the postcard and I still have the original display in my garage somewhere.

No worries, best of luck! I figure the worst they do is say no, but reimbursing only a part is much cheaper than what most have paid at a dealership to fix 😄
 
Received the postcard today. Have the issue, and not fixed yet.

Do I make an appointment at the dealership? Do I have to outlay over a grand to hope I can get it back?

That’s a great question, I’d ask your service center first. As you suggested any out of pocket repairs right now would be at your risk. It may just be a free repair once the extended warranty is approved and in place.
 
Probably in the mail. I received two today, one for 2016 and one for 2019. Not sure if you'll get one for the 14 but defintely for the 19.

Yeah, don't need one for the 2014. It's got a replacement Kenwood in it :)
