I think its kinda silly how much attention this guy has got. People act like someone got away with murder, while he just lost out on getting a sweet car for a ridiculously low price (which normally wouldn't happen if the seller weren't an ebay newb)

I agree...

Did he really think he would get an Evo for that price?
He should've seen it was BS from the beginning...

I agree with you guys, but man think about it, any of us would've bid in hopes of getting a kickass price. Honestly though, there are Ebay rules, blah blah blah, cannot cancel, blah blah, but realistically; yeah he IS owed the car for being the winner, but you KNOW he's not gonna get squat because this isn't a bid on like a little guy selling a watch or something.

The thread is too damn long to follow up on what happened but he did the RIGHT things that any person is entitled to do, he isn't whining or flaming just being informative. Even so though...crap that was an awsome price, w/leather and DVD even...geez.

Still though, im curious to find out how this goes, but im not expecting miracles. :bs:

Yeah it sucks he got screwed...but if its too good to be true..blah blah blah...

Who gives a s***? it's not like someone's life is in danger or something like that, so he didn't get an Evo 26k boo-hoo  .

Man- it's a contract- dealerships screw people all the time, and this time they are getting called out for it- honor your commitments- read the fine print before you jump into the middle of ebay or suffer for it

contract law apparently means nothing to many people around here, it's sad really. if you enter a legal contract with someone (through ebay) and then lie about selling the car (people drove by and saw it still on the lot), you deserve all legal actions that can be taken against you. if he bid on the car, won the auction and then said "no thanks, i don't want to buy it" the seller has a right to (and would) get him in trouble with authorities because they both entered into a contract. contracts are 2 way streets, they aren't only applicable when it benefits one person more than the other.

I agree jred- this kind of thing nowadays is only going to hurt the dealership- I can't believe how much publicity this has gotten- there must be hundreds of thousands of people that know about it- it used to be if you had a bad experience only 10 of your friends would find out- now look at it

First let me say that this guy seems to be a big wiener (complainer) (not dick) than anything else.
But some comments on the already posted comments. $26,900 is not too little or too much. I payed 27 and change. After tax tags and all the fun s*** it was 29,000. Dealers do this everyday. Ever see the infamous ads that are really cheap? Go to the dealer and it will be "just sold"
******* Marketing gimick.
Plus if anyone pays more than MSRP on this car they are crazy and dupped really bad. Not that the car is not worth it but who the hell is going to pay extra?
BTW MSRP is high $28,000. Not too much concidering what you get.

How is this guy a wiener? He made a post stating what had happened -- and in a very professional manner i think ... and followed it up with 1 other comment.

If I had won the ebay auction which is a legally binding contract for an evo with extra work done to it and was told the same thing he was I would be pissed to. Its the dealerships fault they didnt realize they messed up until the auction ended -- they should not take this out on MarkD. The car was "sold" to the winning bidder thru ebay and if it was sold prior (which apparently it truly wasnt) the dealership should have ended the auction before it closed - then there wouldnt be any issues.

perf is right the going price for the EVO VIII is around this auction price, however this is not a stock EVO.

In addition notice at the bottom they have the right to cancel the auction at anytime. Now it gets touchy here cause it states two different cancelation agreements.
1.Before the auction ends
2.Cancel at any time.

I would be upset to, and do not think he is really whining instead he is just stateing what has happen. Its a sweet looking car, and the system inside is a added bonus. If the seller really wants to protect themselves it is best to set a reserve. If the reserve is not met then the auction is void.
