Flat Tire but still decent tread

I got a nail in the sidewall and I have to replace it since it's so bad (Fix a flat didn't work and it goes flat in about 12 hours).

I still have 5/32 or a smidge more of tread left on all the tires. I found a used tire that has 7/32 tread on it, yes it's the EXACT same tire I have. Yay Ebay.

I know the rule about different sized tires on an AWD car can be bad mojo. However, I've called 3 different places and they said "As long as you stay within 3/32 you're fine".

I don't know what to do. I've been trying to do my own research and there are some sites that back those statements and some that don't.

Please help!
 
If you do decide to get a used tire for it I would only keep it on the front of the vehicle because even though the seconds are a slight different it wouldn't hurt anything since we have a transaxle in the front. I don't think it would hurt to put it in the rear because the seconds is measured in depth and not height. But if you want to be safe I would keep it in the front.
 
That's what I was thinking as well. After taking it to a few places I got a measurement of 6/32 on my tread and the used tire is 7/32. After doing the math it's only going to rotate a few (+-3) due to the size. Everyone is saying it's won't be that bad but if I am worried to keep it on the front... which I'm doing!
