i think sueing somebody should only be allowed if it has cost you monetary loss, and the product cannot be replaced. sueing over something that has absolutely nothing to do with money or the loss of human life is bulls***. and who's to blame in this case? you can blame the software inventor, or his or her parents for bringing them up in a household that uses the n-word. you can blame the tag makers for using the software. you can blame the couch manufacturer for not catching the mistake and fixing it before production. you can blame the store that sold the couch in the first place for not proof-reading the labels. you can blame the delivery guys for delivering such filth into your home. you can blame yourself for buying a brown couch in the first place. or you can blame the little girl for knowing how to read and bringing it to your attention in the first place.
 
I wish the law worked like this:

The case goes to court. The couch is brought into the courtroom as evidence. The judge walks down from the bench, looks at the tag, returns to the bench, grabs a pair of scissors, cuts off the tag with the scissors, declares the problem solved and the case dismissed, and tells this oversensitive, sue-happy dumb-ass to get the hell out of his/her courtroom and take her "dark brown" couch with her. Any attempt to appeal will result in jail time for contempt of common sense.
 
^^That works for me, as long as the plaintiff has to pay the court costs, not the taxpayers or the defendant.

do you know how much it costs per year when people decide to bring bulls*** cases to court?

I dont want to pay for those bulls*** cases.... We arent talking criminal court here, of which we do pay. We are talking about civil and small claims court. If you decide somewhere in your whacked head that someone should pay you for your own retarded reality rules concepts, you should have to pay when you lose/it gets thrown out of court.

Makes perfect sense to me.

Question. I saw this a few weeks ago I think. Didn't her mother or someone else order this couch for her? And when you buy furniture,in a store or online,labeled with the color before you buy? Like when ya buy a car for instance. If so, they could have saw the name of the color and thought to themselves hey we can sue for this. Just a thought. Premedetated sueing!

its very possible this is what shes doing. there have been times that i see a speeding greyhound bus, or a truck run a stop sign, and thought to myself "hey, if i let them hit me, i could become rich instantly". of course i would never be so stupid, but im sure there are some people that are that ghey.

Prehaps the court system should change the way we handle business. Perhaps we should place more stock in common sense. We've created this system, we continue to vote for this system so in turn you are responsible for the system.

Yes and no...

We, as a country, can only help so long as there is enough warranted complaints. I cant just raise my hand and say "Yea, lets do it like this..." and have it magically change. I also cant control who and what people try to sue over. Common sense is a valuable commodity these days. Unfortunately we cant stop every dumbass case that comes through the court doors. Id be more than willing to vote on a law of somesort that limited the amount of wasted time to court system has to put up with. However, there has to be more than just myself and enough complaining to get action started to prevent people from sueing over their own lack of braincells. Unfortunately for us, there isnt alot of discussion on this topic to raise peoples' attention to it.
 
Actually attorneys can face censure if they bring frivolous lawsuits to court. They can be fined, or worse.

So what happens when everyone takes your point of view... my hand does nothing. Just like "so what if I don't recycle" or "If a tree falls in the woods and no one is around... does it make a sound?" Maybe we should make it easier for the voice of the people to be heard. Instead of lobbyist speaking for extreme ideas (like Al Sharpton) citzens speak for themselves. Imagine that... a country run by the people for the people.

Oh, also, I just wanted to point out that while we're all discussing how lawsuits like this are a great example of what's wrong with our country, this lady is a Canuk, so any pending lawsuit, and the questionable validity thereof, has nothing to do with the U.S.
