For what its worth, according to two eye witnesses, the collision that cracked up my 9 was primarily the fault of the salesman who was driving way too fast on the congested dealer lot.

I am told that the dealers insurance carries a $1500 deductible, for which he will be responsible. I think that translates roughly to about five sales commissions.

Can you say ouch!

But that aside, the damage to my front end was not critical and the body shop did a quick and remarkable job replacing and painting the damaged parts.

To be sure, the car was placed on a frame machine and an alignment and test drive were performed by their QC personnel. No structural damage was found.

I examined the under body myself and everything seems to be tight and intact. After taking it for a hard drive including some sharp left and right turns and hard braking and backing, it seemed to perform as well as it did before the collision.

Lastly, in a conversation with the service manager, I made it clear that if any component that could reasonably be connected with this incident should fail, e.g., ball joint, tie rod end, cv joint/boot etc., etc., I would expect the dealership to do the right thing.

Cant say any more at this point because Im working on some more initiatives and we just dont know who reads these boards.

Make sure they don't report it to CarFax

I don't know that I have any control over that. I think it depends on what the county/state laws require. No air bags were deployed and since this was all handled in-house, my gut is that they wont report it.

If the dealer makes a claim to their insurance, it probably will be reported to DMV, therefore, CarFax will find it...
In CA, by law, any damage more than $500 needs to be reported. I don't think any agency will knowingly break the law.
Sorry. I hope they don't.

Point taken, and since I do not know what FL law requires as far as accident reporting is concerned, I can't comment. Maybe someone conversant with reporting regulations will weigh in.

The CarFax thing is a real pain. I just traded in a ML320 when buying the Cx9 and even though the accident was a simple glancing blow to the rear bumper just requiring paint, the fact that it was in the report was something the dealer had to take into account as he was putting the trade up for auction and any negatives on CarFax drop the value. Probably cost me $500-750 in trade value.

IslandTractor, would you divulge your state, the repair cost, who did the repair (dealer, private shop, etc) and any other info that could shed light on the Carfax reporting responsibilities. Thanks.

Should've tried to get diminished value payment from them. Since the car was damaged, the value diminishes and they should pay you the difference.

I did that when my MS6 was in an accident.

This is the "nightmare" that we all have whenever we leave our vehicle somewhere for servicing. Sounds like the dealer was coopertive and did the right thing by you, as they all should if we lived in a perfect world. Yeah right!
